Recently, I encounter an accident while driving my motorcycle. I hit an old lady and rush her to the hospital. Thanks to GOD she didn’t receive serious injuries. After receiving the CT scan result and confine for 2 days in the hospital – I was relieved to know that everything goes well (Ok ra tanan result). By the way, the collision happened on the fly over – and this is the scenario.
7:10 PM in the evening, I was about to go home after buying some stuffs. I was never drunk or tired - 100% of my ability I am able to drive (wla jud ko ka.inom or unsa). From a distance I already saw the old lady going to across the street. She is waiting on the other side of the street and I don’t know why she is crossing the street at the end of fly over (nahitabo neh sugod jud sa fly over - nagbarog xa sa island2x nga yellow color di-in mag sugod gani ang flyover) where cars, motorcycle, etc. is in high speed going down and going up. So, I blew a horn repeatedly (mentras nagminor) to acknowledge my presence. When I was about to pick up speed (30-40KPH padulong pako hunat kay sagka-on man) going up the fly over and suddenly there she goes running to avoid the car going down. I applied the brake as hard as I can (break jud sa taman nya ako lawas naa na sa manobila tungod sa kalit na pagbreak) but it was an avoided impact between my motorcycle and the old lady. I manage to maneuver the motorcycle (ako gilikay ang motor para dili xa ma.igo pag.ayo) to keep her not being run over the wheels. She was hit on motorcycle side mirror, hand steer and front wheel. Then by standers rush to me and her, saying “Dad-a dayon hospital bai”. Somebody call a taxi and someone help me carry the old lady going to the taxi. While carrying the by standers said “OK rah ka nay? Maayo gani nakalikay ka sa auto padung ubos. Nya bai kaw ok rah ka bai? “And I said “OK ra!” I left the motorcycle at the incident happen and trust somebody which i didn't to care the motorcyle for me (maayo gani guard to xa sa kilid).
My problem is that…the daughters and sons of the old lady had paid the hospital bills. By the way, I rush the old lady to the public hospital (CCMC - kay mao lagi wla ko kwarta) but they decided to transfer her to a private hospital (CEBU DOC). They said I should repay them in all the expenses the spent. I just said yes that time because of not knowing what to do. And then came the paying time. I said I cannot pay them fully (10K) I don’t have any work – I only work part time jobs and have a daily earnings (Part -time raman gud neh ako-a). I reason out that, can we split the amount? (Hangyo ko nga tunga meh sa gasto kay mao lagi disgrasya man jud ang tanan kinsa may gusto mahitabo neh) Because I said it’s not my fault. But they said I should pay or else they will sue me.
I would like to ask…what should I do - I don’t have enough money? If they sue me what are the consequences. Where can I go to seek help, in case they sue me? (unsay pwde ikasao nila nako? crimanal case?)I really need some advice. What are the criminal cases that they can file against me? They threat me to file a case because they know influential people and know some lawyer (Naa man sila kaila gud nya abobogado pud - naa man ko ikahatag pero dili pa.igo sa ila pangayo). I earn by day and don’t know any lawyer to help me. I really need some help. …Thanks/Salamat! God Bless….

kung imong motor insured, pwede ka mu claim og third party liability sa insurance company. pag inquire lang didto nya mangayo na silag requirements nimo like police report, receipts, etc.

Yep, claim sa imung TPL bro. etarong lang og storya ang family nga wala gyud kay kwarta, and ang imu lang is lihokon gyud nimu ang insurance and paninguhaon nga madali..

bro, sa ako pagkahibalo, gamay ra kaau na nga amount para idala sa court.. if insured imung motor, ang insurance ang mobayad ana.. pasabta lang ang pamilya bro nga wala jud kay kwarta but naka ingun man jud ka ug yes na ikaw ang mobayad so liable jud ka mo bayad.. pwede nimu ingnun na imung hinay2x ug bayad... pe

ang problema man gud naa documents gipangita ang insurance..nga dili ko ka.provide kun dili ang victim...pero naglibog ko if dili sila gusto mohatag or wla...den ila man gud ko gipadali2x na unsaon man wla jud ko kwarta...unya napaet pa..gihulga nako nga ikiha kay daghan sila kaila..unya kini insultohon tah nga dili tah katubay kay lagi di tah gusto masamot pa..

i think mura, and kapaet pa jud suspended ka sa driving mura kuhaon imo license.. but dili na mahitabo if ma setle nimo sa victim side..

mura ma suspend rman imo licence ani bro up until makabayad ka(provided nga nka kuha sila ug police report sa hitabo). nakaligis ko ug bata sauna sakyanan paman gani gyud to. ingon ang police nga i-settle lng pra wla konsensya. usa pa wala man kaha mo binding contract na unsa inyo pamaagi sa pag bayad. by bulk or ginagmay or tunga sa gasto. all boils down sa right na argument ug right answers.

Ondo,u shud claim the benefits if ur motor vehicle is under insurance. be sure to work with the papers and give time to this matter for easy solving.

with regards to ur concern sa lawful issue dear .. yes,they r capable of taking legal action out of the situation..ma-sala man sa biktima o dili, partly our prohibition sa reckless driving stated na ang driver jd ang responsible in any rationale. i jst dnt knw particularly undr wat constitution nd section ni xa. [ltry to make a research] m nt 2knowledgeable about it. ^_^

btw,you've also mentiond d details about d scenario dba..well b4 my dad shared to me about some ways/means of defending "reckless driving"

this is very related to ur case as stated "d fact that u tried to avoid an accidnt or collision after the old woman actually caused/created the dangerous situation that gave rise to the accident". probably this explanation/statement can help to guard u if ever ul be examine for a criminal case. let's pray and hopefully it wudn't happen.


anyway if u dnt mind me,i wud love to give u a friendly personal advice pd,if i were u try to explain more jd to the victim side...win their compassion,that's very important,extend ur patience as much as u can.. dnt get irritatd if dey're pushing a force paymnt frm u,dnt let the feeling of fear and guilt rattled u.this is very unhealthy guide in dealing problems.be humble and be positive instead. talk to them , do things that will possibly encourage them to cooperate with you. don't think it's impossible,try and try jd authenticity will samhow help you.


Ondo,lastly i wud jst like to remind u though i knw ur doing ur part,pls jst keep moving forward with God's supervision,do ur best and God will surely do the rest.
