Need legal advice on vehicular accidents

Mga bai. Need your advice lang beh.

I got into an accident.
My car got hit by a speeding motorcycle sulod sa village driven by a slightly drunk driver.
Also, the motorcycle has no registration yet kay bag-o pa.

After investigation and as per police blotter, siya jud ang sad-an.
Gikuha ang iyang driver's license and as per advice sa police, we need to settle things out.

Ang problem is, karon, they are hesitant to shoulder the cost of total restoration sa ako sakyanan tungod kay mahal lagi. Of course, they were with me during nagpa estimate ko for repair cost.

I already offered to shoulder some of the replacement parts. But then it seemed nga we still could not agree on the costs.

Unsa man jud ako ma-hold ani? As advised by the traffic officer, maglisod man sad daw sila hold sa license sa driver.

As much as possible, di lang ko sa kiha2x usa kay hasol na.

kumusta condition pud sa motor sir? madala paba ug bawi na lang and sell the motorcycle to shoulder the total repair cost? any way sila man ghapon sad.an and if dili sila mu shoulder sa expenses, might as well have them sell the motorcycle na lang. just a thought.

Yup, sell the motorcycle if they can't shoulder the cost.

Or have them shoulder the participation fee if you have own damage coverage sa insurance nimo. But that might raise your insurance premium next time mag renew ka.

The motorbike is still new, less than a month pa that is why wala pa rehistro.
I think under installment man sad tingali ang motorcycle...

I checked with the traffic police nga nakaduty ganina and he told me nga I can file a lawsuit. Pwede ra daw no lawyer if you file directly to them.
Unsa may process ani?

Ask lang sad ko if ang mga naka-installment nga motorcycle ba always na jud na nga registered na sa buyer or sa tindahan pa?
If sa tindahan pa, then ang case will be filed vs the store di ba, which is mao pa ang registered owner? so ang tindahan na ang maningil sa nakabangga.

if location pasabot nimo, diri lang sa lapulapu...sulod sa usa ka subdvision.

ang nabanggaan sa awto nako is kanang sa driver's side nga fender diha na dapit sa may signal lyt.
Nya sa kakusog sa impact ang entire bumper na hiwi hasta sad sa pikas side...

Buak ang signal lyt ug ang fog lamps.
Ang fog lamps ang nakamahal sa replacement parts kay last quote ani nako sa Gemini is 12K pero naa sa manila 9K 2nd hand.
That's on top pa sa bumper/fender/hood restoration cost with painting.

Di lalim gastuhan nya di sad maayo gastuhan kung dili ikaw ang responsable.

if im not mistaken drunk driving kay usa sa daku nga offense. if proven drunk driving ang nka motor im not sure if pwede marevoke iya license or mo agi lng xa ug seminar before nya makuha iya license.

and if ang iya motor ky wla pa jd na process ang rehistro during sa accident i guess pwede na imbargohon sa LTO iya motor for driving an unregistered vehicle pero if nagprocess or nka proces na ang rehistro sa motor sa time na nakadasmag xa then murag lusot pa xa. not that sure pero just my point of view lng.. kaso sa sulod man pd gud sa village nahitabo ang accident so murag libog pd gamay.

HAsol gyud kaayo ang accident labi na gyud ug wala or maglisud ug bayad ang nakasala. NAka-try nako ani sa una, wala gyud mabayari tanan kay nalooy nalang ko nadugay ... hehe

As much as possible, di lang ko sa kiha2x usa kay hasol na.

morag wala jud cguro nay ikabayad sir, looking into consideration nga installment sad ang iyang motor, my suggestion is, ask the traffic officer to issue a TOP aron ma suspended ug 90 days ang iyang license kay basi unya ug makabangga nasad na sya diha ug usab but i think the best solution is to file a case aron Police na maoy mohimo ug action sa imong kaso.
