CA junks Mandaue City mayor's appeal for TRO
The Court of Appeal junked Monday Mandaue Mayor Thadeo Ouano's petition for temporary restraining order against the preventive suspension order issued by the Office of the Ombudsman due to a technicality.
A DZMM report said the appellate court"s 18th Division, headed by Presiding Justice Artemio Magpale, junked the petition after Ouano failed to attach a certified true copy of the Ombudsman's order in his petition.
Court spokesman Joseph Stephen Ignacio said Ouano only attached a press release of the Ombudsman's order.
Ouano's lawyer, however, said he has already submitted a supplemental motion with a certified true copy of the order.
Last week, Ombudsman Merceditas Gutierrez ordered the six-month preventive suspension of Ouano, Lapu-Lapu City Mayor Arthuro Radaza and 17 other local executives and public works officials for the alleged overpricing of decorative lampposts installed during the Association of Southeast Asian Nations Summit last January.
The Ombudsman based her decision by comparing the Programs of Work chart prepared by Mandaue City and the cost of importation documents for each lamppost. The Ombudsman found out that the cost of the lamppost was 10 times higher than its actual cost.
The cost for a single lamppost is only P7,356 but both cities charged P72,500 for each. The overcharging in the purchase of the double armpole, triple armpole and the apex and dome like armpoles were also allegedly applied by the local government units and the DPWH in Cebu.
"The subject lighting facilities, as acquired and/or paid for by the government, were highly overpriced," the Ombudsman said.
