    Default House Bill No. 2295 “The Maintenance and Welfare of Parents, Senior Citizens ACT"


    Looking after your parents or other elders in the family may no longer be just a moral obligation.

    This, as Senior Citizens Party-list Rep. Godofredo Arquiza filed a bill seeking special protection for parents should they be abandones by their own children.

    “Many children nowadays, after having been reared, loved, nurtured and sent to school by their parents, have totally abandoned their parents for selfish reasons,” Arquiza lamented.

    House Bill No. 2295 or the “The Maintenance and Welfare of Parents, Senior Citizens and Elderly Act” will guarantee the economic stability of parents, senior citizens and the elderly, the lawmaker said.

    If the bill is passed, a parent or senior citizen or elderly can file an application for financial support against his children or grandchildren or other relatives within the fourth degree of consanguinity.

    “The obligation of the children or grandchildren to maintain his or her parent or grandparent extends to the needs for food, clothing, medical attendance and treatment,” the bill stated.

    The measure also provided that the child or grandchild who refused to accept their parent or grandparent in their home despite having the financial capacity to do so could be imprisoned from six months to six years.

    Meanwhile, neglected parents, grandparent or elderly may apply for financial support in the Family Court where he is residing. The Department of Social Welfare and Development and local government units will then provide the victims' temporary shelters, counseling, rehabilitation programs and livelihood assistance. The Department of Health should also provide medical assistance.

    DSWD already expressed its support for Arquiza’s bill and has submitted recommendations to enhance the measure.

    “The moral duty to maintain parents is recognized by the conservative Filipino people. Every effort shall be exerted to protect their welfare so they may live peacefully in the remaining years of their life,” Arquiza said.

    because the government is too corrupt or too poor to provide welfare support to its citizens, the task has been thrown back at us. I'm all for supporting our elders but forcing us to do so and extending it up to the fourth consanguinity is outrageous.

    Politicians never change. since they've robbed the government coffers dry, they have to justify government duties that have been left to the citizens to do themselves. This is one example.

    i know my obligations to my parents and he (tongressman) doesn't need to shove it into my brain. this has a very high potential for abuse by abusive,negligent and undeserving parents and senior citizens. tongressman arquiza should look deeper into the long term effects of this bill.

    good to hear bout this one.. at least we can assure the welfare of our elderly after they ran out of gas for them to supply their own needs.

    @7DMM: that's precisely the point. These dumbass congressmen NEVER look at the long term effects of these so-called bills and laws. Look at the law that prohibits imprisonment of minors, di tanan nga mga snatcher kay bata.

    a perfect example is the US "anti-spanking" law. Every single american is spoiled and going wild because no one has taught them to be disciplined in their ways, to practice self-control. Ang bata dapat tud.luan ug sakto unya usahay kinhanlan maka.tila ug sakit para makahinumdum gyud. apan naa gyuy mang.abuso ana but the benefits far outway any other negative scenario.

    what's the connection of this said bill to the juvenile act of kiko? This law is only for the protection and welfare of our elderly when time comes that they can't sustain their needs..

    IMHO, this is a total different law compare to the juvenile act, though there might be loop holes on this one, but the impact is not totally similar.

    the point is RA 9344 of kiki and this house bill are both sources of abuse for those who wanted to take advantage of it. i pity those good parents abandoned by their children but i don't blame if bad parents are left for dead by their children.

    i can imagine family members suing each other for money. for me supporting our parents when they grow old is a moral responsibility and should not be made into a legislated obligation concocted by someone for fame and fortune.

    don't worry guys..............regardless if this will pass as a law or not, we're already full of LAWS that are really just SUGGESTIONS.............

    like 7DMM, we don't need a law for this....we already have something that most pinoys have....utang-buot....and let me add respect...
