Fake is such a strong word bro. OEM is a bit softer in the mind kay what people dont actually talk about is that the sound quality from the genuine beats and the OEM ones are actually the same. Its just the quality of materials that it differs (though the genuine ones break easy too as far as the people online say) so hence Fake would not really be a good application.

P.S. SMART Audiophiles would also tell to stay away from Beats and even Skullcandy. You can get better quality soundwise and material wise from other brands. (Sennheiser, Audio Technica, etc)
