I was wondering if this is some sort of exploitation or violation here. Have any of you ever purchased gadgets (PCs, cellphones, appliances) in a mall from stores that are reputed to be based in some other city (usually Mandaue)?
A few years back nagpalit ko ug LCD Monitor from this Chinese-own computer store (wink wink). Naa man to issue iya dead pixels.
Anyway, to cut a long story short it ended up in some heated argument between the store and lawyer friend of mine.
When he reviewed the receipt it had a TIN number and a place of issue as "Mandaue".
This caused him to raise a question. Why is a Mandaue-based store issuing their receipt in a Cebu City mall? Dili daw ni pwede because you are only authorized by where the receipt is supposed to be issued.
Iya daw duda, tax loophole ni sa mga tindahan sa mall. They do not claim the store to "sell" anything but claim they are "service centers" or "distribution centers" wherein no transaction ever takes place. In retrospect ,duha daw ang alkanse ani:
1) The mall which usually has profit sharing clauses cannot claim a cut from these establishments because "supposedly" they do not generate income (when in fact they do). Rent nalang puhunan.
2) Cebu City mismo walay madawat na tax from these establishments because of, again, no income.
Taxes in Mandaue are lower than in Cebu City, mao siguro they claim to have made the sale in Mandaue when the transaction actually happened in Cebu.
Be aware mo ani mga istoryans. Ayaw na padatua kanang mga lintik diha. If your receipt is not issued for Cebu City then this is tax evasion.
