    Default NON-Cebu City Receipts issued in Cebu City-based malls


    Guys,

    I was wondering if this is some sort of exploitation or violation here. Have any of you ever purchased gadgets (PCs, cellphones, appliances) in a mall from stores that are reputed to be based in some other city (usually Mandaue)?

    A few years back nagpalit ko ug LCD Monitor from this Chinese-own computer store (wink wink). Naa man to issue iya dead pixels.

    Anyway, to cut a long story short it ended up in some heated argument between the store and lawyer friend of mine.

    When he reviewed the receipt it had a TIN number and a place of issue as "Mandaue".

    This caused him to raise a question. Why is a Mandaue-based store issuing their receipt in a Cebu City mall? Dili daw ni pwede because you are only authorized by where the receipt is supposed to be issued.

    Iya daw duda, tax loophole ni sa mga tindahan sa mall. They do not claim the store to "sell" anything but claim they are "service centers" or "distribution centers" wherein no transaction ever takes place. In retrospect ,duha daw ang alkanse ani:
    1) The mall which usually has profit sharing clauses cannot claim a cut from these establishments because "supposedly" they do not generate income (when in fact they do). Rent nalang puhunan.
    2) Cebu City mismo walay madawat na tax from these establishments because of, again, no income.

    Taxes in Mandaue are lower than in Cebu City, mao siguro they claim to have made the sale in Mandaue when the transaction actually happened in Cebu.

    Be aware mo ani mga istoryans. Ayaw na padatua kanang mga lintik diha. If your receipt is not issued for Cebu City then this is tax evasion.

    mao, you may not need to report it to BIR but you can report it to the local mall admin. I'm pretty sure they are more effective in handling these issues.

    this is somewhat true but there is also this thing as we called as "the other side of the coin".

    ang uban dili na lang mo report ky hasulan na. kahibaw na baya mo sa system sa pinas nga pwerteng ka complicated.

    ang uban ky dili na pud mo report ky mawad-an mn og gana tungod ky walay action.

    you'd be surprised how effective this is bai. i even got a legal threat from a certain cellphone store a few years ago for posting in istorya about my experience with them which they claim is UNTRUE.

    i told him my lawyer is free, how much is yours? by the time the case is over ang expenses incurred niya molabaw pa sa presyo sa cellphone iyang giiwas ug replace sa ako. hilom laging insika.

    but to answer another question here, if sa ayala mo mureklamo or sa SM, YES mo action na (although SM is based in Mandaue so vice versa lang na receipt inyo bantayan. basin cebu receipt na). unlike going to court ang admin naman mo take over sa issue. just give the receipt as evidence.
