    Default kinsai nka sulai og file og case sa NLRC


    I want to file a case to my previous employer kai wla pami tagae sa amo last pay. Mga nov. 2010 ko ni resign sa kani na company den hantud rn wla pjd amu last pay hasta kato mga kauban nko na ng una og resign mga May pa wla psd cla tagae nya ang nka pait rn kai ng close nani cya na company mga last week bsi to sa January. Den ako ge try og send og message sa skype ang tag iya sa company den dli mn mu reply, ang iya pud right hand kato admin namo kai offline pud prmi sa skype.

    Unsa jd angay nko buhaton ani mga istoryans? Need your help

    Adto sa RAB babaw sa Letty;s drug store dayon if naa naka didto naay reception area pa signun ka ug complaint form and pa checkan nimo ang mga violations sa employer.Naa na didto ang non payment sa suweldo and wala sad ka hatagi sa uban nimong mga benipisyo like overtime,13th month pay and the likes cheke na didto tanan.

    maybe nag file cla ug bankruptcy claim sa government?
    if thats the case then dli na priority na bayran mo sa company kay they need to settle all thier debts to their investors first using the remainder of their asset. and the fact na sarado na cla, wla na ang entity na imo mafilan ug kaso, mura ka nag knock sa balay na wlay sulod.

    I think wla na cla ng file og bankruptcy sa government. kalit ra gni to cla og close. ako mga kauban na nahabilin dd2 na hibong cla kai pg abot nla dd2 pdng unta cla work kai g.panghakot nmn ang mga gamit. Wla pd dw cyai bayad2 sa rent sa bldg. naa pa gni to cyai contract sa usa namo ka client iya nlng g.byaan og kalit.

    Payslip ug company ID bai pagmatuod na trabahante ka nila. Ang burden pag prove na dile tinuod imong allegation naa nila. Mao ray dalha didto,cla nay bahala ug allegar na dile tinuod imong pasangil nila.

    nakasuway nako file complaint sa nlrc and nakadaog akong case. The NLRC upholds the rights of the workers and if naa lang ka proof of your employment with the company, everything will fall into place. Pwede ra ka muadto sa ilang office sa may fuente then fill out sa form. Tagaan ka ana ug schedule ug kanus a ka pwede mag submit sa imong affidavit and ang company will be summoned to do the same thing. For the affidavit, you need to find a lawyer to do it for you... ang next ana kay i schedule mo for amicable settlement. If you cant come up with an agreeable solution, ang judge na ang mudecide sa inyong case.

    for my experience, it took about a year for a resolution. Akong nabayad sa lawyer kay 11k and was granted my compensation but without back wages. It was illegal dismissal and suspension.

    i suggest you and your coworkers file a complaint together kay it'll be stronger, as advised by my lawyer before. Have all your docs ready coz you will need it... it's more like battle of the paperworks than actual case. Your lawyer will pretty much do everything for you.hope it helps.

    sis ask lang ko, unsa nga illegal dismissal and suspension ang imoha nga case? pila sad ang nabayad sa company sa imoha? nag pabayad sad ka sa moral damages sa pagkatanggal nimo sa trabaho? interesado lang ko makahibaw kay naa koy friend morag same nimo ug case, illegally dismissed sad pero wla xa niadto ug NLRC.

    long story man to ako...but the bottom line is...nasakit ko, wala gi honor akong med cert kay dili certified sa among HMO akong doctor and gi suspend ko through text, pending investigation daw. we had a meeting with HR supposedly so they can hear my side but I was advised to submit a resignation letter. WA KO NI HIMO UG RESIGNATION LETTER KAY AT THE BACK OF MY MIND, I'M DEFINITELY NOT GOING DOWN WITHOUT A FIGHT! aw..hahahaha

    so mao to sya... ni contact dayun ko ug lawyer. As long as wala ni submit ug resignation letter, you can contest it sa NLRC especially if wala'y due process.
