Two counts of libel filed by Cebu City South District Rep. Tomas Osmeņa against businessman Jonathan "Atan" Guardo have been elevated to the Regional Trial Court.
The raffling of the two charges will be held Monday next week in order to determine which court will hold the hearing and trial.
The Cebu City Prosecutor's Office in its information dated July 26, 2010, recommended a bail of P10,000 for each count of libel.
To recall, Osmeņa, then the city mayor, sued Guardo last January 21, 2010 for allegedly uttering malicious and defamatory statements that came out in a local newspaper dated January 10 and 11, 2010.
Last January 20, 2010, the Cebu City council, feeling aggrieved and insulted by Guardo's statements, passed and approved Resolution No. 10-1769 granting Osmeņa as mayor of the city to file the said complaint.
"What worries me is the pattern of harassment City Hall has deployed against the opposition. They removed my boards, prevented me from entering barangay gyms, deprived opposition barangays of gasoline allowances, stopped Cogon Pardo's medical mission and now this Calamba incident," the local newspaper quotes Guardo as saying.
Guardo, touted as the leader of the opposition, ran as congressman in Cebu City South against Osmeņa during the May 10, 2010 local and national elections but lost.
