    Default NEED HELP: vehicle transfer of ownership issues


    good pm mga bros and sis,

    nakapalit ko ug awto last year and everything naa tanan gikan sa previous owner like CR/OR and deed of sale nga notarized na pud. problem is i wasnt able to transfer the ownership under my name kay wala jud ko time kay na timing pud larga2 ko. karn expired na ang registration niya and we are planning to sell the vehicle pud kay mao lage talagsa na kau magamit since nausab ako job nga required mag larga2.

    ako pangutana is pwede paba ma transfer ang ownership and register the vehicle under the new buyer's name inig ka halin dri sa amo?mura ug ni ambak bitaw ang pag transfer. owner A (previous owner) sold the car to owner B (me) but transfer of ownership and registration not transferred to owner B. Owner B wants to sell the car to owner C (prospective buyer) and have the transfer and registration processed by him instead under his name.

    pwede ba ni cya?

    hope anyone can help kay gusto napud mi ma dispose ang sakyanan kay tagsa ra magamit. WA LANG JUD MI TIME MAG PA REGISTER ANI AND I THINK MAS MAAYO KUNG MA SOLD ANG CAR, MA REGISTERED NA CYA DIRETSO UNDER THE NAME SA NEW OWNER.

    Pwede man na cguro bro. Pero mas maayo kung naa ka maistorya nga suheto ani. Naa ko kaila nga mao sad tigparegister sa ako vehicle. Sige lang ako lang siya pangutan-on about your case kung unsay maayo buhaton. Post lang nya nako diri kung unsay kalambuan.

    YOU CANNOT transfer from Party A to Party C UNLESS the Deed of Sale shall be changed from PARTY A and B to PARTY A and C. You have to transfer it to your name first.

    Nothing more, nothing less

    Bro, you have 2 options:

    Option 1 - You as Party B can execute a Deed of Sale to Party C because you have a Deed of Sale from Party A that supports your ownership of the vehicle. As to registration with the LTO, you will pay for 2 registration fees (for sale of A to B and sale of B to C), plus penalty perhaps for late registration of the sale from A to B.


    Option 2 - If you can talk to Party A, request him to execute a Deed of Sale direct to Party C. This way only 1 registration expense is involve. In such case, offer to Party A that if he is amenable to execute the sale to C, you execute a cancellation of the previous sale (refers to the sale of A to B) for Party A's protection.

    thanks everyone for the suggestions.

    @ zebran - it seems option 1 is a bit harsh since 2 fees will be paid. instead of me not paying for the registration for this year, it seems i still had to pay for it. my bad though since i wasnt able to work on this beforehand. but option 2 seems to be a viable solution. i hope party A understands the situation but if everything falls out, no choice but to use option 1.

    any other suggestions as to those who have experienced this kind of problem?

    you're welcome bro. by the way, these are the only options, in my opinion, that are feasible from the legal point of view.

    i see. thanks again bro. i guess ill work on it this monday. first thing to do is transfer the ownership before registration dba?

    execute deed of sale first in accordance with either option i suggested above, then present to LTO for registration.

    hala... meaning, di diay nako ma transfer ang ownership sa car nga ako bag-o napalit?? tsk...tsk.. my case is much more complicated....

    I bought this car from party D... Meaning I'm already the 5th owner of this car since this is an old 91 model car. Daghan na naagian nga owner pero wala nila gi transfer ang ownership.. Only deeds of sale and original CR/current OR are evidences of ownership. Registration were renewed yearly w/out any problems but of course the name in the registration is still the original owner...

    Worst is we don't know the whereabouts of owners A, B, and C... so talking to Party A requesting him to execute a Deed of Sale direct to me is not possible.

    I have all the deeds of sale of all the parties; from party A to B, B to C, C to D, and D to myself...

    Any option you could suggest? Please help!
