Default Dealers pass off some cars as new? (how true?)

According to a news article in sunstar dated Sunday, April 20, 2008:
The scam, Atty. Jade Ponce said, involves the tampering of importation records to fool buyers into believing that a car, which has probably been sitting in a showroom for months, just recently arrived from the manufacturer.

The defense of Jose Cuenco, Toyota Cebu general manager is that:
“Toyota is selling brand new units. Even display units are considered brand new,” Cuenco said.

“We sell showroom units. All dealers do that,” he said.

for me display in the showroom are considered brand new but the problem in the complaint is that there was misrepresentation from the agent.

that's right... he manipulated the papers of the car to make it look like the car just arrived in their dealership...
cars in the showroom are brand new and as such, there should have been no need for him to be devious...
