For the impatient and those peddling malice on Gwen's complaint with the BIG 3...

CEBU, Philippines – The three major oil players in the country were given until Tuesday to answer Cebu Governor Gwendolyn Garcia’s Omnibus motion regarding the complaint she filed on the alleged disparity of fuel prices here compared to Metro Manila and other places.
The Petron Corp., Chevron Philippines Inc. and Pilipinas Shell Petroleum Corp. were ordered by the Department of Energy and the Department of Justice joint task force to submit their rejoinder affidavits to the reply-affidavit on July 14 at their central office.
“Failure to file said rejoinder-affidavits on the same date shall be deemed waiver on the part of respondents to file the same,” read the order dated July 2.
The two-page order was signed by state prosecutors George Yarte Jr. and Diosdado Solidum Jr., and prosecuting attorney II John Benedict Medina.
Last July 1, the task force received a copy of Garcia’s reply-affidavit dated June 30, in which they filed a manifestation with Omnibus motion setting for the date and time for the complainant to submit their joint reply.
In the same manifestation, Garcia asked the task force to conduct the hearing of their petition here in Cebu.
Garcia went to the Department of Justice as she sued the Pilipinas Shell Petroleum Corp., Petron Corp. and Chevron Corp. for alleged violation of Section 11 of RA 8479 or the Downstream Oil Industry Deregulation Act of 1998.
The law penalizes cartelization and predatory pricing of petroleum products.
The issue on the disparity of fuel prices, according to Garcia was raised during the meeting of the Phil-Export Cebu and the Cebu Chamber of Commerce and Industry with President Gloria Arroyo in her recent visit to Cebu.
The complaint was also signed by Samuel Chioson, president of Cebu Chamber of Commerce and Industry; Efrain Pelaez Jr., president of the Mactan Island Chamber of Commerce and Industry; Eric Mendoza, president of the Mandaue Chamber of Commerce and Industry; Jay Yuvallos, president of the Philexport-Cebu; and Filomeno Lim, president of the Federation of Filipino-Chinese Chamber and Commerce-Cebu.
Garcia said her fight against oil companies does not only concern her and the chambers of commerce.
Garcia already has the support of the Philippine Councilor’s League informing her that they will come up with their position in supporting the provincial government.
The case stemmed from the alleged inexplicable higher prices of fuel by about P5 to P8 per liter in Cebu than in Metro Manila and other key cities in the countries.
Garcia earlier said it seems that there is really a huge discrepancy and injustice being committed by the big three against the people of Cebu. — Garry B. Lao/BRP (THE FREEMAN)
