Hi istoryans...

I just need your advise. Im having problem with my dental clinic. I just found out this afternoon nga among bookkeeper wala jud ni bayad sa BIR. Now naa na mi pending case sa BIR and we need to pay 1000 each month plus naa pa additional... for 2 years wa jud niya bayari.

Never jud mi ni skip ug hatag niya ug money and we gave her 1k each month. naa cya gi signan diri sa among clinic nga iyang gi kuha ang money and also her 1k per month.

Any suggestion please?

what documents can you support to implicate him/her. Do you have a signed contract that s/he will handle your bookkeeping? unsa man na document iya gi signan, acknowledgment receipt lang? walay specific kung para asa to na money na inyo gihatag niya?

examine his/her employment contract if it's well stated there, his/her duties which includes responsibilities, liabilities & accountability.

The most likely cases are establishments employing or hiring personnels or staffs
that's not even given or have undergone the standard process of employment like
a well stated, binding and legally credible contract or a well documented appointment of duty
usually when it comes to this kind of case, anha na sila maka lusot sa gray areas common to
defective contracts...though I'm not referring to this case.

basta TS...ako suggestion is have lawyer examine documents or contract linking his/her accountabilities regarding this matter

pila man ang bayranan nimo karon sa BIR including sa penalty? Compute it very well before going to the lawyer. Remember, standard acceptance fee sa lawyer is more or less 20T. Plus filing fees. Plus appearance fees. Plus hassles. Plus, the person involve is nowhere to be found at the moment.

Remember, that even if you win the case, you'll still have to pay to the BIR. Cases will drag for years.
It really depends on your objectives, if you really want to teach the guy a lesson, no matter how expensive it is, then you can proceed filing a case. You need to find that guy first. Maybe talk to him/her first. If it can be settled amicably, then that would be best.
