THE 16-year-old boy who was allegedly hit in the head with a rock by a Cebu City councilor was discharged from a public hospital last night.

Jan Niño Pogoy and his mother Mila left the Vicente Sotto Memorial Medical Center (VSMMC) past 10 last night, said his father SPO4 Samuel Pogoy in a text message to Sun.Star Cebu.

Samuel said they have to pay P90,000 for the fees of doctors who operated on his son. He did not mention their hospital bills, which he said Councilor Gerardo Carillo has promised to shoulder.

Pogoy’s son landed in the hospital after a rumble outside Kuerks Restobar on Pelaez St., Cebu City last July 7.

The policeman said the family is still uncertain if they will file a complaint against the public official.

He said they were focused on the boy’s safety and that he would depend on his wife and the witnesses in deciding whether or not to press charges.

Three witnesses earlier told the police that it was Carillo who hit the victim.

But Carillo denied the allegation. Two witnesses also showed up at the National Bureau of Investigation (NBI) 7 and said in their affidavits that they did not see the councilor during the melee, which involved teenagers.

Samuel visited the NB) 7 to meet with supervising agent Rennan Oliva yesterday afternoon. He informed the agent that his son was still in VSMMC at that time.

Oliva, a lawyer, said he had sent a subpoena to Jan Niño, requiring the latter to present himself, accompanied by a guardian, for an inquiry.

He will set another date for the meeting with the Pogoys.

Oliva will also send subpoenas to the three witnesses who pointed to Carillo as Jan Niño’s attacker. He will ask them to execute affidavits.

“Whoever is at fault, we will file a complaint against him based on the evidence,” said Oliva in Cebuano.

The other witnesses, Mario Buella and Zyle Jourdan Saturinas, were interviewed by Oliva last July 19. They said they never saw Councilor Carillo during the rumble.

In his affidavit, Buella said he saw teenagers fighting each other while he was on a break from his work in the Aznar Compound, Osmeña Blvd. last July 7.

“I suddenly noticed a stone was flying. The next thing I observed was that somebody fell down. Blood was already spilling from (his) head,” he said.

He referred to Jan Niño, whom he later saw being transported in a car. The other teenagers scampered in different directions. Buella said he knew Carillo because the latter is a public official.

For his part, Saturinas, 23, said he did not see Carillo during the incident. He said he was hanging out with Eman Clifford Fuentes, Earl Edward Cutanda and Reyhcard Cosep inside Kuerks.

The incident occurred around 3:40 a.m. last July 7.
