Hey mga dude, share nyo nman idea nyo skin, ano ba maganda mag file ako sa DOLE or hindi nlang? ganito kasi 4 years na ako sa internet cafe nag work tapos kmi nag handle sa isa sa mga branch ng cafe, sinara yung cafe at itininda noong November 30 2005 sinadya yta para wala kming mga bunos na matanggap, medjo humina kasi ang kita ng cafe kaya isinara naman.... ang tanong ko kung incase bigyan lang kami ng 4,000 or 5,000 or kaya 10,00 tanggapin ba nmin ito or mag file nlang kami sa Department of Labor and Employment para sa separation fee namin.. what do u think mga dude? ok ba ? plz share naman mga idea ninyo... Hindi ko kasi alam ang gagawin....

generally, separation pay is 1 month for every year of service...u worked for 4 years so that's 4 months...i suggest you go to the Public Attorney's Office (PAO) and ask for legal advice. it's located at the ground floor of the Hall of Justice Bldg., at the back of the Capitol...good luck....

yah, basically that is the assumption but there are some exception to that, if the reason for closure of business is due to bankrupcy (if they can legally prove that) then they are only obligated to pay 50% of your monthly compensation for every year of service.
As what Minuano27 told you... adto ka PAO or DOLE and ask for assistance...

hehehe. separation pay may only be given on separation from work due AUTHORIZED CAUSES.... ie: redundancy, retrenchment..... pero if natangtang ka sa work with CAUSE, dili ka ka claim anang separation fee. but u can file a claim before the NLRC kay severed naman ang inyong employee-employer relationship, and u can alleged that u are illegally dismissed from service.... u can even charge them for nonpayment of 13th month pay, 5 days incentive leave, etc.... adto lang sa PAO to further this advice.. .naa ko daghan classmate did2... a piece of legal advice for u to ponder... pwedi sad ka adto deretso sa NLRC, atbang sa anitas bakeshop, dapit dunkin donuts fuente, 2nd floor. ciao..

no offense `pre ha, but better mo adto usa siya sa PAO...kay kung deretso sa RAB-7, magkinahanglan man pud na siya ug lawyer later on and maka-adto ra gihapon siya sa PAO...so better na lang na tabangang siya sa PAO every step of the way....

Wednesday morning around 9:00am dumating ang employer ko with his wife tapos yung kasamahan ko pinauna mag pirma ng kanyang separation fee, for 3 years 3,000 lang na received nya, tinanggap nya, then pagkatapos nya ako na naman, binasa ko muna ng mabuti ang nkasulat 3x habang nag iisip ng mabuti, ganito ang natatandaan ko I ________ accepting the amount of wages. ##$^^^&& including the holiday fee, 13th month fee, separation fee, etc.. @##$% etc…. tapos tinanong ko ang boss ko kung magkano ang ibibigay nla sakin, sabi nya 4,000 so naisip ko 4,000 lang tapos nandon sa papers including the 13month and separation fee, if ang 13th month is 3,000 so 1,000 lang pla ang separation fee ko from 2001 to 2005? Kaya hindi ko tinaggap.

Then pumunta ako ng NLRC. On January 11, 2006 ang hearing nmin tapos process ko din ang complain ko about sa SSS ko, hindi nahulugan since 2001 -2005 so daku daku jud ang mabayaran sa akong employer. If e deny ko niya naa man pud ko evidence kasohon jud.

You know mga dude kung ge treat lang unta ko tarong sa among employer modawat ko bisan 4,000 lang kbalo pud gud ko maluoy, kaso maluoy ka sa imong employer unya imong employer dili kabalo maluoy natong mga pobre so maayong putlon ang sungay aron dili mag anad abi pobre mga non-educated nalang jud ta. Pagbaligya sa iyang business, pagkadawat sa pera wla man lang formal na decision kung asa name assign or wait nlang ba kha me sa seperation fee, basta nalang me gibiyaan pagkadawat sa money… Nagtarong me ug trabaho ug pang encourage sa mga costumer aron daghan ang sales unya ani lang diay.

Wla kaming ginawang masama sa business nila or sa employer, wla me nkasala, gibaligya lang jud nila ilang business kay loosing n daw pero nkapalit ug sakyanan.
