    Default Certificate of employment and last pay


    PLEASE HELP...

    Hi to all, i need help on this matter kay wala ko idea kung naa ba balaod nga pila ka months limit nga pwede ma release ang akong certificate of employment sa company nga akong gi trabaho.an saona nga dili na mo exceed og almost 1year. kay 10months na karon gikan sa pag resign nako. nya cge baya ko follow-up nila din ilang reply "gi process, walay maka sign kay ni biyahe outside the country ang boss, busy daw sila"... i told them that i need it so badly kay akong gamiton for applying visa abroad. ok ra unta ilang ihatag una akong certificate of employment bahalag walay last pay. kay perting dugaya jud.

    please..help...help...help...

    Dali raman kaayo na ang CoE, ang last pay ususally mao na ang ila iprocess but I think ususally dapat mga 2 months naa na na... tell them sa next follow up nga if dli pa sila ka hatag dayon, mu reklamo na ka sa DOLE, ana-a lang gud para ma hadlok. I think you have a right man sad na mu reklamo ana if grabe na ka dugay nya cge ka follow up...

    “Section 6, Rule XXIII, Book VI, Rules Implementing the Labor Code of the Philippines”

    “SECTION 6. Certification of employment. — A dismissed worker shall be entitled to receive, or request, a certificate from the employer specifying the dates of his engagement and termination of his employment and the type or types of work on which he is employed.”

    mao na ang naa sa Book 6 of Implementing Rules sa Labor Code nato, pero kani cya murag dili na tagaan ug pagtagad sa kasagarang employer kay wala man ni cya ngipon tungod na wala man silot bisag kapila pani i ignore sa employer.

    actually adunay Senate Bill ( Senate Bill No. 1061 ) nga nag amendya ani, gibutangan na ni ug ngipon aron kahadlokan ni sa mga employer, gipasa ni cya nga bill 2 to 3 years ago na nya hangton karon wala tawon ni cya gai ug pagtagad sa senado.

    gabaan ta sila!!! kadugay ba anang COE... gaunsa gd ni ilang Boss, galaaglaag? Moanha ra sa companya para mangiti?
    so kindly ask them again when is when mn gyd moabot inyong former Boss? para maklaro gyd...

    Or basin nangita ni ug Datong ning HR para mapirmahan?

    my advice, go to NLRC opposite Anitas Bakeshop sa uptown. and file a complaint against your previous employer coz with a labor case nga wala sila mobayad nimo sa imong separation and last pay is already a violation. sure ko, ora mismo mohatag dayon na sila sa imong demands...

    usually ang CoE e release na dayun prior sa last day sa imong work together with your last salary...kana kung wala ka nag AWOL.

    paugatay man sab kaayu na nga compaby bai. Pag pa clear naq kai nakuha rapod naq ako COE. Pero ang last pay kai usually 30 days,
