How to detect if scam or not

1.) Legal companies have products = ROI upon registration
2.) Legal companies are SEC registered
3.) Legal companies have DTI/BFAD registrations
4.) Legal companies literally give commisions for product sales not on referral alone.
5.) Legal companies operate for more than 10 yrs or more..not newly created!
