NBI autopsy findings show victim was mauled
By Kevin A. Lagunda
Wednesday, April 24, 2013
FINDINGS of the second autopsy conducted by the National Bureau of Investigation (NBI) 7 on the body of a suspected shoplifter who died inside Metro Gaisano on Colon St., Cebu City contradicted the ones conducted by the police’s medico-legal officer.
Last Friday, Dr. Nestor Sator, head of the PNP Crime Laboratory, said 23-year-old Mario Alfie Ducayag’s death may have been caused by asphyxia due to pulmonary tuberculosis. Asphyxia is the lack of oxygen or excess of carbon dioxide in the body.
Sator did not rule out foul play.
But according to the autopsy conducted by the NBI 7’s medico-legal officer Dr. Rene Cam, Ducayag’s cervical vertebrae were dislocated, and he had bruises in his palms, right shoulder, chest and his back.
Cam said the victim’s lungs also had congestion and bruises, while his left lung collapsed.
Cam said Ducayag probably fought back against the persons who mauled him.
NBI 7 Agent Bernard dela Cruz said the management will cooperate with their investigation and will provide them with what they need, including the CCTV footage of the alleged shoplifting incident.
Condolences
This was confirmed by Metro Gaisano spokesperson Cerwin Eviota.
“While the separate autopsies conducted showed different results, the company (Metro) will cooperate with authorities to get to the bottom of this incident. We also would want to know the truth. We trust in the competence of both the police and the NBI to determine what happened,” he said.
“Our cooperation extends to the security agency concerned. The company has mandated them to cooperate in the investigation as well. We will take appropriate action based on the outcome of the investigation,” he said.
“It is unfortunate that this incident happened. We are deeply saddened about it, and we also condole with the family for their loss,” Eviota added.
Metro personnel accused Ducayag of stealing a pair of slippers.
But it turned out the victim was looking for his lost receipt when he was apprehended, dela Cruz said.
The slippers were also registered in the cashier’s machine, he said. “He (Ducayag) was even given change.”
Last April 12, Metro’s security accused the victim of stealing. The incident happened at 2:30 p.m.
Suspended
While he was questioned inside the security office, the victim reportedly collapsed and started frothing in the mouth. He died minutes later.
Security guards Margie Gacer and Cesar Celerio, chief security Mauricio Doblados, security camera operator Geoffrey Aquino and three others are under investigation for their role in Ducayag’s death.
The guards are suspended pending the outcome of the investigation, dela Cruz said.
Police reports earlier said Ducayag was buying items inside the Metro. He was about to leave when Gacer noticed a pair of slippers inside his bag that had not been allegedly paid for.
Ducayag denied stealing the item. Also found in his bag were diapers, baby’s milk and biscuits.
Gacer brought Ducayag to the security office for questioning.
Doblados, Aquino and Celerio were inside the office to help Gacer question Ducayan.
The four reportedly tried to handcuff Ducayag, but the latter allegedly resisted.
Ducayag allegedly collapsed during the scuffle.
The victim was taken to the hospital, but he was declared dead on arrival.
