    BIR Mandaluyong Padlocks Popular Chinese Restaurant
    For having committed gross violations of the National Internal
    Revenue of 1997 as amended (Tax Code), the most obnoxious of which is
    gross underdeclaration of sales, a popular Chinese restaurant was ordered
    closed yesterday by the Bureau of Internal Revenue (BIR).
    Temporarily suspended from conducting its business operations after
    the Closure Order signed by BIR Commissioner Sixto S. Esquivias IV was
    served and enforced was HAN NAN FOOD CORPORATION, more popularly
    known as Han Pao Tea House (Han Pao), with business address at No. 312
    Shaw Blvd., Mandaluyong City.

    Revenue Region (RR) No. 7, Quezon City Regional Director Antonio F.
    Montemayor said that the closure of the said restaurant showed his region’s
    unwavering determination to shut down businesses with no intent to shape
    up and comply with tax laws. He further said that those who mend their ways
    will be adequately assisted and treated like other good and compliant
    taxpayers.
    The closure order was served after Han Pao failed to comply with the
    48 Hour Notice and Five Day VAT Notice issued and served by the BIR. The
    said notices gave Han Pao the opportunity to explain its side and present
    evidence to dispute the BIR findings.
    Among other violations such as failure to pay correct income tax,
    failure to supply correct and accurate information, attempt to evade or defeat
    tax, and perjury, field personnel of BIR Revenue District Office (RDO) No. 41,
    Mandaluyong City unearthed under-declarations of sales by 205.44% in
    taxable year 2007 and 176.26% in 2008 amounting to P13,917,937.28 and
    P13,253,535.15, respectively. Value Added Tax liability was estimated at
    P5,344,704.50 for both years in question.
    The subject restaurant is eighteenth (18th) on the list of business
    establishments closed by the BIR nationwide. According to Revenue District
    Officer Isabel A. Paulino of RDO No. 41, Mandaluyong, many more
    recalcitrant taxpayers in her district are in the pipeline – on her desk -
    waiting to be padlocked! She added that unless they heed her advice and
    voluntarily comply, she will have no choice under the law but impose punitive
    actions like closure or suspension of business operations.
    Among those previously padlocked by the BIR under this program
    were: 1) La Suerte Grocery & Bakery in Magalang, Pampanga for failure to
    declare more than P50M income in 2008; 2) Charmy Food Phils., Inc., a
    manufacturer of soybean products in Pasig City, for not declaring P40M of its
    sales for 2005-2008; 3) Arra’s Fine Dining, a Korean Restaurant in Makati
    City for understatement of its taxable sales in 2008 by more than P20M; 4)
    Hilton Mart Corporation, a Grocery (Wholesale and Retail) business plying its
    trade in Manila, for underdeclaring its sales for taxable year 2008 by more
    than P1.2B; 5) Skywater Enterprises in Davao City for underdeclaring its
    sales by P12,590,943.55 in 2008; and 6) Wil-An Mart, a wholesale and retail
    grocery business in Manila, with sales underdeclaration in 2008 of 196.24%
    or P142,466,017.80.
    Oplan Kandado is the flagship project of the BIR initiated by
    Commissioner Esquivias which aims to strictly enforce sanctions for noncompliance
    by business establishments with requirements of the Tax Code.
    RR No. 7, Quezon City Assistant Regional Director Jonas DP. Amora
    believes that through Oplan Kandado, taxpayers will be compelled not only to
    comply with the requirements of the Tax Code but also to pay the correct
    taxes in conducting business, lest their operations will be subject to closure

    If only the government used 100% of the taxes for the benefit of the people, none would have been greedy to give to the government.

    Sad to note, but instead of praying for the govt officials, many are hoping to kill them 1 by 1 to end up the miseries of the Filipino people caused by their corruption.
