    yes boss. OFW raka kung naa kay contract ug registered ka sa OWWA/Embassy. veloso is NOT an OFW. wala siyay contract. she went there as tourist looking for work. maybe she was taken advantage or she could be a willing victim. only the investigation will reveal all this things. ang big fish ani naa sa malaysia, didto ang starting point.i don't think malaysia is included in the investigation. if mo abot sa point nga mag prosecution, ang recruiter ni mary jane mapriso, si mary jane ma execute. pero ang katong mga mastermind aw yahay au.ihap sa daghan kwarta. kanang recruiter ug drug mules, dali ra au na nilang ma ilisan.

    let's take a closer look sa MLAT...

    when can MLAT be invoke?
    Article 1 Paragraph (2)
    2. Mutual assistance to be rendered in accordance with this Treaty may include:
    (a) taking of evidence or obtaining voluntary statements from persons;
    (b) making arrangements for persons to give evidence or to assist in criminal matters;
    (c) effecting service of judicial documents;
    (d) executing searches and seizures;
    (e) examining objects and sites;
    (f) providing original or certified copies of relevant documents, records and items of evidence;
    (g) identifying or tracing property derived from the commission of an offence and instrumentalities of crime;
    (h) the restraining of dealings in property or the freezing of property derived from the commission of an offence that may be recovered, forfeited or confiscated;
    (i) the recovery, forfeiture or confiscation of property derived from the commission of an offence;
    (j) locating and identifying witnesses and suspects; and
    (k) the provision of such other assistance as may be agreed and which is consistent with the objects of this Treaty and the laws of the Requested Party
    ARTICLE 10. OBTAINING VOLUNTARY STATEMENTS
    Where a request is made to obtain a statement from a person for the purpose of a criminal matter in the Requesting Party, the Requested Party shall endeavor, with the consent of that person, to obtain that statement.
    however under Article 15. of transfer siya diris a pinas prisohon gihapon siya in accordance to indonesia's domestic law.

    being said, when can MLAT be invoke?, as Art 1 stated to assist in criminal matters, question now is why it took them a while to invoke this?, it is only recent that the suspected recruiter was in custody of the PNP (voluntarily asked for assistance).. why did the govt DIDN'T invoke it even before the suspected recruiter came into light?

    since the victim is already in prison in indonesia, she wasnt able to execute a sworm complaint against the suspected illegal recruiter, so why did the DFA/DOJ didnt initiate and get the sworn complaint from her?, did the indonesia govt forbid our govt from doing so?, i dont think so

    the govt is aware that MJ "might be" a victim of human trafficking, so why did the govt only at the last minute?, and not on the time where she was caught!, we've been on this road before

    corrections:

    MJ did send her affidavit multiple times, but apparently it didnt reached to her family.

    Oct 25, 2010 - Migrante: Mary Jane’s family received a call from her to wish her son a happy birthday. Since then, they had been able to communicate with Mary Jane regularly via phone. They told Mary Jane to write an affidavit, and send it to them via mail, detailing the events that led to her arrest to be used for the complaint they wanted to file at the Philippine Drug Enforcement Agency (PDEA) against Tintin.
    Nov 2010 - Migrante: The family received post mail from Mary Jane containing photos but no affidavit. They called Mary Jane who was in turn surprised that her affidavit did not reach the family. She said that she would be sending them her affidavit again soon.
    Dec 2010 - Migrante: The family received another post mail from Mary Jane, again containing photos and a bandanna from a priest, but still no affidavit. They immediately reported this to Mary Jane who confirmed that she sent her affidavit along with the rest of the mail’s contents.
    Feb 10, 2011 - Migrante: The Court of Appeals of Yogjakarta upheld Mary Jane’s death penalty sentence.

    The family reported the missing contents of Mary Jane’s mail to Joseph Ladip of PDEA.
    migrante is aware of the said affidavit and yet they only inform the govt on february 2011, thats 3 months after the first one..

    July 2013 - Migrante: Mary Jane sent her sister Maritess her hand-written affidavit via courier (LBC).
    still they didn't invoke the MLAT despite this....

    murag binuang mani nga timeline boss.

    kakita ko ani:

    Dec. 30, 2013

    Migrante: Indonesian Pres. Joko Widodo issued Presidential Decision No. 31/G – 2014 rejecting the request for clemency on behalf of Mary Jane.
    how can widodo issue a presidential decision on December 2013 when he won the presidential election on July 2014? during these time december 2013 he was still a governor of Jakarta. governors cannot issue presidential decision.

    Thankful for the postponement of her sentence that will be carried after her recruiter's trial ? cmon ok na nimo kutob ra ka " last minute remedy " ?
    Thankful pa guro sila kung gi pang extend ilang family stay sa Indonesia. Momentarily spared siya but wa siya maistorya didto.
    Di pa siguro katilaw ug resbak ang government.

    How about this : "maniningil kami!" & "Hindi gobyernong aquino ang tumulong sa amin." etc.. are these not an insult?
    Again, like you said, its just a postponement.
    So? undangon sa nila ang paglabay ug uban pang dili maayo nga istorya, ky whether they like it or not ONLY the government can help them for now. NOT the Migrante, priest etc..
    You called that insult ? mura ra gani manigil ug "utang" iyang storya Opinion lang pud nila na, for them "truthful" pa gani na.
    And what you mean "only the government can help them now" ? Walking dead na gani si MJ.

    I just hope bai, I wont catch you here in Istorya.net complaining against government cause you will be eating your words. Kaklaro na the government failed her, moingon pa ka na be thankful.
    kung naa gyud bati makit-an sa gobyerno... naa gyud ikasulti naa mareklamo PERIOD.

    Time and time again the government had failed our OFWs, mao ra ako big message here. tan-aw nimo this is the first time it happen ?

    The issue here is not about technicalities as whom you'll give the credit, blame or whom they should be thankful.
    They should have not done discrediting gov't's effort. Pwede mn dili mngayo ug pasamalat, pero ayw lng pud pang-insulto ky temp pa ni tanan nhitabo..
    I lost you here...

    Technicalities ?

    Unsa man gyud concern ni Penoy or Binay ? mas kay Binay pa gani ni na failure. Considering presidential adviser of OFW concerns si Binay.
