1987 CONSTITUTION ARTICLE XV
THE FAMILY
Section 1. The State recognizes the Filipino family as the foundation of the nation. Accordingly, it shall strengthen its solidarity and actively promote its total development.
Section 2. Marriage, as an inviolable social institution, is the foundation of the family and shall be protected by the State.
Section 3. The State shall defend:
(1) The right of spouses to found a family in accordance with their religious convictions and the demands of responsible parenthood;
(2) The right of children to assistance, including proper care and nutrition, and special protection from all forms of neglect, abuse, cruelty, exploitation and other conditions prejudicial to their development;
(3) The right of the family to a family living wage and income; and
(4) The right of families or family associations to participate in the planning and implementation of policies and programs that affect them.
Section 4. The family has the duty to care for its elderly members but the State may also do so through just programs of social security.

*This is a deterrence against infidelity.
Under the RPC masayon iprove ang adultery compare to concubinage. Under this bill, wala na differentiation sa gender. So I am wondering why the violent reaction against this bill? this is just a mere corrective action in view of the existent law on concubinage and adultery.
The Constitution doesn't say anything about going to the extent of sending people to prison just to save a marriage. This is purely ego tripping and fanaticism on the part of our politicians. This law intrudes on the freedom of individuals and the penalty is grossly out of proportion with the crime. If this law is enacted, the Philippines will have the honor of joining the elite group of backward, fanatical countries such as Iran, Saudi Arabia and the like. What kind of democracy enacts laws like this anyway? If we do this we have no right to call other countries oppressive societies.
In any case I'm not at all surprised that a law like this would be enacted in this country. We've already been going backwards, why not step on the pedal and go full speed backwards in time towards the middle ages?

I’ve observed that your posts in this thread keeps mentioning the Islamic countries like Iran, Saudi Arabia and the like calling them fanatical and backward which will create something negative and degrading to the mind of the readers. Is that really true? These countries as I’ve known have long been recognized the rights of women with minor exceptions due to their customary traditions like in the Saudi Arabia where women are not allowed to drive a car. In this case, infidelity, women in these countries were allowed to divorce their husband if they felt they are unequally treated and neglected. In these countries marriage is sacred and the peace of the family is to be respected, and divorce an unpalatable and detestable thing. Society is responsible for removing the causes and incentives to divorce, but at the same time the law should not bar the way of divorce for incompatible marriages. And these countries recognized that man by nature is polygamous, so if a man would like to enter into a polygamous marriage he should be ready to provide his wives equality in matters of financial, emotional, physical and all aspects that will create harmonious marriage life. Here in the Philippines, lots of women enter into Islam just to avail the Divorce Law which was provided in PD 1083 which is known as Muslim Personal Law because they were already neglected by their husbands and filing an annulment is so costly for them unless their husband will initiate and will bear the burden of cost in filing it in court which usually is not the case. So many women were barred from legally married again because they cannot afford to have their marriage annuled, so kalooy kaau ang mga babaye.
