    This law actually isn't needed. Philippines has laws that cover the same acts and have penalities/fines/jail time. Problem is they are NOT ENFORCED....This law seems to be enforced heavily and favorite but gets abused quite often by some women.

    You should still have classification of crimes as Misdemeanor A B C E F G...etc and Degree of Assault or Threat or whatever. Some crimes or reporting don't fit Provincial Level and are more handled at Municipal. This law will eventually clog the system with unnecessary exaggerated cases and many that are Non-Violent Reported Potential Offenses.

    Also women can report or file cases 6 months after or 60 years after. The Law here has a 6 month RULE but this 9262 negates that...Only for WOMEN.

    It should apply for men also or both should be under the 6 month policy.

    Laws should be fair and equal for both parties.

    Also the punishment doesn't make sense in this law...


    1 month for assault?

    6 months for threat?

    shouldn't it be the other way around??

    No but it's not necessary. Just as there is NO NEED for a RA 9262. You already have laws covering all this stuff but the problem again is it's NOT ENFORCED. So they just slapped together this law to blanket everything...make the legal system easier for victims to file cases and prosecute and punish criminals. But it gives an unfair advantage. regardless if they are criminals or not and found innocent...it's still unfair.

    Plus this law has a LESSER PUNISHMENT for assaulting women than the standard battery and assault laws in the Philippines.

    6 Months in Jail for Threat?

    huh?

    it should be the other way around.

    better off filing an assault charge on the higher degree cause you can nail more jail time.

    good point made. RA 9262s have been dismissed in attorney's office and court because the situation or incident doesn't really fit a crime or it's so small or minor it would be better filed under a different violation and lower court.

    In reality both men and women can act violent. In some rare cases the women can be more violent and even commit murder. Women are in police and special forces so they have the ability to kill. Anyone that argues that women are sweet innocent and nice and can't put up a fight or fly off the handle violently...is mistaken.

    Women compete in olympic boxing, taekwondo, muay thai, Brazilian Jujitsu, Greco Roman Wrestling, Knife Combat, Special Forces, Snipers, Police, Jail Officers etc....

    Women are just as capable equally as men and sometimes in rare cases even stronger physically.

    Rare you'll come across one but they exist..

    Juvenile Act also is a mess.

    No need for a RA 9262. Philippines has laws covering all this stuff but the issue they are NOT ENFORCED very often or taken seriously. Police are not much help in situations and BPOs don't do much. Women can get an assault or battery charge filed against them by their husbands. not a VAWC type law but still does the job.

    Just make sure it's within 6 months of the incident. Women have an Unlimited eternal window to file anything and everything now that they choose. Under one law.

    Also why is adultery or infidelity a crime punishable with YEARS of Jail? The child still has a mother and father regardless how messed up the situation. It's a civil matter not a criminal one and also non-violent. Throw the dad in jail and you might as well take away the financial support produced by the guy too who can't work now.

    Unfaithfulness doesn't mean they are bad parents and bad providers.
