    The 59-year-old father of a youth whom Joavan Fernandez and five companions allegedly kidnapped and mauled, took the witness stand yesterday to recount his experiences in the time before he managed to get his son back from the accused.

    Oscar Abellana seemed nervous while testifying and had to drink a glass of water while narrating the incidents of Aug. 11, 2008 in the courtroom of Regional Trial Court Judge Manuel Patalinghug of Branch 22.

    Yesterday was the first trial for the two counts of serious illegal detention filed against Fernandez – adopted son of Talisay City Mayor Socrates Fernandez – and friends Benedeck Gabasa, Mark Perez, Teodero Ligaray and two minors.

    Abellana, who was secured by three marshals from the Witness Protection Program of the Department of Justice, pointed to Fernandez and his five companions as the ones who kidnapped and mauled his son Osbert and nephew Winston Abellana.

    He said Fernandez and his companions brought Osbert to his home in Talisay City and mauled him.

    Abellana said that past midnight on Aug. 11, 2008, while he was sleeping on the rooftop of a vulcanizing shop in Talisay City, Osbert told him that Fernandez took Winston and forced him to board his vehicle.

    He admitted that he did not personally see Fernandez doing the alleged act.

    When Fernandez left, Abellana said he told his son to close the vulcanizing shop and pray for Winston’s safety.

    But about 15 minutes later, Fernandez came back and kicked the door of the vulcanizing shop open.

    Abellana said one of Fernandez’s companions informed the mayor’s son that he and Osbert were on the rooftop.

    Abellana said Fernandez forced them to get down. While they were talking, Fernandez pointed a gun at Abellana and asked him to board his vehicle.

    At that point, Osbert was surrounded by Fernandez’s companions.


    Abellana said he begged for mercy from Fernandez, saying that he even painted Fernandez’s house a few years back.

    When Abellana was forced to ride Fernandez’s vehicle, he managed to escape.

    He said he left his son behind and sought police assistance.

    After more than two hours, Abellana said he and the police managed to rescue his son and Winston from the house of Fernandez.

    When they arrived at Fernandez’s home, Winston’s face was covered with blood coming from a cut in the head, while Osbert had contusions in the forehead.

    Police then arrested Fernandez’s five companions.

    Fernandez, however, eluded arrest.

    He was later arrested by agents of the National Bureau of Investigation in Central Visayas on Oct. 7, 2008 inside a spa in Talisay City for another charge.

    Fernandez, Gabasa, Perez and Ligaray are detained at the Talisay City Jail in barangay Maghaway, Talisay City, while the two minors were released last month to the custody of their parents.

    After the hearing, Mayor Fernandez was seen outside Branch 22 but he refused to issue a comment.

    George Bragat, Fernandez’s counsel, also declined to say anything because he said he did not want to preempt anything.

    Abellana will be cross-examined by the defense counsel on Feb. 26.
