But this case is hardly just about FB postings (I think). Might even be politically-motivated. The actual message reads "Do you know nga kung dili nimo tarungon ug verify. Ikaw ang mahimung kataw-anan kay it would seem like mas bogo pa ka sa nagtaho nimu kay nisulod ka sa iyang bulsa?" so I think lawm pa ang issue ani than just the FB.

The message was also sent in private so it can't be considered as "circulated" unless gipagawas sa recipient mismo. I need to re-read this pero I think for it to be called libel it has to be read by other people than the parties involved.

Also, there's still a whole lot to be determined for Internet/Online Social Networking issues. Naa na ba tay balaod governing the Internet?

bro, we have a new law against online bullying and that is internet libel. Ive been a victim of these type of online bashing and as a recipient its never easy to sleep at nights thinking that your name is plastered on social networks and being labeled with certain names. Whether accusation is true or not (referring the case of the V-Mayor) posting negative, derogatory comments on a public cyber place to malign and put malice is already considered as LIBEL.

Though it was a private post, even at least 1 person reading it means its already a publication. Though the posters account maybe private his posts is still viewable to a number of people (lets say his friends list on fb). And according to my lawyer, 1 page where it is published is considered as 1 count...so if you posts something in various number of pages, imagina pila ka counts ang atubangon sa offender.

Hope I enlightened you bro and sis with this.... So be a responsible poster, because you dont want these simple negligence to bite you in the ass someday!
