DR CARL BALITA IS NOT INVOLVED IN THE “PT EXAM LEAK THAT LED TO THE BLACKLISTING OF RP” (As featured in a cover story of Philippine Star dated July 14, 2010 by Jess Diaz)
Dr Carl Balita was named in the copyright infringement case cited in the website of the Federation of State Boards of Physical Therapy (FSBPT). This was only because St Louis Review Center (SLRC) rented the venue of his review center for the conduct of a Physical Therapy Review at the time that a raid was conducted by NBI agents in search for evidences against SLRC. This case was investigated and heard in the Department of Justice (DOJ), and was “dismissed for insufficiency of evidence” in a Resolution signed by Chief State Prosecutor Jovencito R. Zuno on August 17, 2009.
The resolution cited that “it is worthy to note that respondent Balita’s field of endeavour was actually limited to nursing profession and not to physical therapy.” The resolution acknowledged that Balita “merely sub-leased spare room to respondent Martin.” SLRC owner Tong-An was also cited in the resolution to have certified that Balita is exclusively engaged in the nursing review.
A motion for reconsideration filed by the FSBPT was denied in November 19, 2009 as approved by Chief State Prosecutor Claro A. Arellano. It is noteworthy that the dismissal of the case happened twice by two Chief State Prosecutors.
Balita, who is also Vice President of the Review Center Association of the Philippines (RECAP), is saddened by the news of the FSBPT’s suspension of National Physical Therapy Examination (NPTE) for all graduates not only of the Philippines but also of schools in Egypt, India, and Pakistan. He however hopes that the security measure being set up by the FSBPT will be in place soon to assure validity and reliability of the examinations. He remains an advocate of integrity and honesty in the licensure examination as he holds three professional license and through the years has contributed in his personal and professional campaign for a credible licensure examinations.

A doctor who was among the respondents in a copyright infringement case yesterday presented rulings by the Department of Justice (DOJ), which cleared him of involvement in the alleged leakage of exam questions in the state-administered physical therapy exam.
In an interview with The STAR, Dr. Carlito Balita said that the US Federation of State Boards of Physical Therapy (FSBPT) only implicated him in the case because the St. Louis Review Center (SLRC) was renting part of the space of his nursing review center at the time agents of the National Bureau of Investigation (NBI) raided SLRC.
The case was investigated by the DOJ and later dismissed by Chief State Prosecutor Jovencito Zuño on Aug. 17, 2009 for “insufficiency of evidence.”

Will any exceptions be made to the policy of suspending testing for graduates of physical therapy schools in the restricted groups?
If the candidate can demonstrate that he/she did not receive the first-professional physical therapy degree from one of the identified countries, then staff will work with the candidate to resolve the situation.
However, if a candidate falls into the definition of a restricted group with respect to the NPTE, the board will not hear appeals to be removed from the restricted group or the requirement to be limited to taking the NPTE-YRLY form as a result. The board has carefully defined the restricted group and discussed how first professional degree is defined. The board decision to limit testing for a defined restricted group, based on school of first professional degree, would not be subject to appeal.
