MANILA, Philippines - The camp of Ang Galing Pinoy party-list Rep. Juan Miguel "Mikey" Arroyo posted bail Tuesday on the tax cases he and his wife, Angela, are facing before the Court of Tax Appeals.
Arroyo's lawyer, Ruy Rondain, said he is posting P20,000 bail per case. He said his clients decided to post bail immediately to dispel speculation that they plan to leave the Philippines to escape the charges.
"You voluntarily surrender to the court and post bail. They are willing to face the case against them," he told ANC's Dateline Philippines.
Rondain said the cases filed by the Department of Justice against the Arroyos are not technically tax evasion but failure to file income tax returns. He also questioned the DOJ's decision to place the Arroyos in the immigration watchlist.
In a 28-page resolution dated September 16, 2011, investigating prosecutors Senior Assistant State Prosecutor Lagrimas Agaran, Assistant State Prosecutor Ma. Cristina Montera-Barot and Assistant State Prosecutor Mederlyn Mangalindan recommended the filing of 7 counts of violation of Section 255 of the National Internal Revenue Code (NIRC) against Mrs. Arroyo for failure to file income tax returns (ITR) for taxable years 2003 to 2009, and 3 counts of violation of the same section of the NIRC against Rep. Arroyo for failure to file ITRs for taxable years 2007, 2008 and 2009.
The panel also recommended the indictment of Rep. Arroyo for 3 counts of failure to supply correct and accurate information in his tax returns for taxable years 2004, 2005 and 2006.
The Bureau of Internal Revenue (BIR) filed tax evasion complaints against the couple in April for allegedly willfully and, with intent to evade paying the correct amount of taxes due government, substantially underdeclared their income for taxable years 2004, 2006 and 2007, and altogether failed to file the required tax returns for 2003 to 2009 for Mrs. Arroyo, and for taxable years 2005, 2008 and 2009 for Rep. Arroyo.
The BIR placed the couple's total tax liability at P73.85 million.
The BIR complaint stated that using the Net Worth Method (NWM) in tax investigation, it was found that there was "substantial underdeclaration" of their income for the subject period by more than 30% following a comparison made between the increase in the couple's net worth and their reported taxable income for the same period.
Under the NIRC, an underdeclaration of at least 30% constitutes prima facie evidence to evade or defeat payment of taxes.
