(UPDATE) PRESIDENT Gloria Macapagal-Arroyo has issued an executive order barring key government officials, including those from the military and the police, from appearing in any Congressional inquiry without her consent.
The order came 28 days after Malacañang vowed a crackdown on illegal street protests, and amid rumors Arroyo was considering a declaration of martial rule.
Executive Eduardo Ermita announced Wednesday the new policy contained in Executive Order 464 as the Senate was to start its probe on a number of controversial issues involving the President and some Malacañang officials.
"While they are not being prevented, [Article 6,] Section 22 of the Constitution provides that they have to get the authority from the President through their department heads," Ermita said in a news briefing.
Section 22 reads as follows:

rules of each House shall provide, appear before and be heard by such House on any matter pertaining to their departments. Written questions shall be submitted to the President of the Senate or the Speaker of the House of Representatives at least three days before their scheduled appearance. Interpellations shall not be limited to written questions, but may cover matters related thereto. When the security of the State or the public interest so requires and the President so states in writing, the appearance shall be conducted in executive session."
Covered by the order are senior officials of executive departments, military generals and flag officers of the Armed Forces of the Philippines, key Philippine National Police officials, senior national security officials, and other officials as may be determined by the President. Senate President Franklin Drilon and other senators earlier said the Senate would pursue its investigation into the Venable deal, the wiretapping controversy, the illegal numbers game "jueteng," the North Rail project, and the raid on the house of opposition document expert Segundo Tabayoyong.
The Senate on Wednesday began its probe on wiretapping, but administration Senator Miriam Defensor Santiago cancelled a committee inquiry into lobby deal of Malacañang with American Law firm Venable LPP.
Presidential management staff chief Rigoberto Tiglao said Executive Order 464 was issued to ensure the observance of the principles of separation of powers, adherence to the rule of executive privilege, and respect for the rights of public officials appearing in legislative inquiries.
Last Wednesday, National Security Adviser Norberto Gonzales was summoned by the Senate to shed light on the contract he signed with Venable LPP, which was meant to woo US support for a number of government projects, including Charter change.
Under intense grilling, Gonzales refused to answer key questions from Senators. He was cited in contempt and ordered detained in the Senate. Rumors spread over the weekend that Malacañang would declare martial law, but the Palace was quick to downplay it for lack of justification.
But it did not rule out a takeover of key private industries under emergency rule.
Citing threats of leftist infiltration and business disruptions, Arroyo scrapped the maximum tolerance policy last week in favor of a "calibrated preemptive response" to demonstrations.Wa na uy gobyerno Gloria -100 ang credibility.

MAYORS and governors have been allocated a total of P8 billion in pork barrel under Malacañang's proposed 2006 national budget, sending alarm bells ringing in the House of Representatives.
"It's an opportunity for big use, and a very big door for abuse," Davao del Sur Representative Douglas Cagas, vice chair of the House appropriations committee, said at the budget hearing yesterday.
Pork barrel finances pet projects of members of the House of Representatives and the Senate and is believed to be a source of kickbacks.
Expensive cars, bodyguards
The pork barrel for local executives comes in the form of the P5-billion Kilos Asenso Support Fund and the P3-billion Kalayaan Barangay Program Fund, according to Cagas and other lawmakers.

He noted that the amount allotted for local executives was more than the P6.2 billion in pork barrel of all members of Congress under the Priority Development Assistance Fund (PDAF).
The PDAF was cut this year to P40 million from P70 million in 2004 for each member of the House and from P200 million to P120 million for each senator as part of the government's cost-cutting measures. A number of congressmen, however, received funds from the road users' tax for the maintenance of roads in their districts.
Impeachment complaint
Iloilo Representative Rolex Suplico claimed that the pork for mayors and governors was part of the war chest of Ms Arroyo to keep the support of local executives should the opposition revive the impeachment complaint against her next year.
Suplico said Ms Arroyo even wanted P650 million in intelligence funds next year.
"I'd like to assure the members of the House that the Kilos Asenso is meant to be released only if we feel that the project is a good one," Budget Secretary Romulo Neri said.
But Cagas said the local executives could misuse the funds in many ways.
"They can present programs or projects but later on convert (them) into payment of casuals. Everything will be used for personnel, bodyguard, peace and order, intelligence funds. If we do not accept that situation we're naïve. If we're that naïve, this country does not deserve to continue to exist," he said.
COA audit
Budget Undersecretary Mario Relampagos said the Commission on Audit had internal and post audit "just to make sure that disbursements are compliant with existing rules and regulations."
Relampagos said the President had also issued Executive Order No. 70 and Memorandum Circular No. 89 mandating government agencies to strengthen internal audit.
"So I hope this information helps us address your fears ... that money is not wasted," he said.
Cagas was unimpressed. "It is true that the Commission on Audit is the one responsible (for the disbursed funds), but we can contribute opportunities of corruption by providing more funds. We must make some corrections first before we provide some funds," he said.
Auditors' office
He said his apprehensions could not be assuaged by an internal audit. "You know why? Where are the auditors holding office? In the capitol. Who are providing for their air conditioners, the capitol, the City Hall," Cagas said.
Cagas proposed strict guidelines for the disbursement of the Kilos Asenso and Kalayaan funds.
"Don't rely on projects submitted to you by the governor or mayor which appears to be very beautiful projects. After your approval, they can make changes without you knowing," he said.
