the one you quoted is in the INVASION OF PRIVACY section article.... the name itself is INVASION OF PRIVACY not INVASION OF PUBLIC ACT... should be simple enough to understand.

that section 5 can only be applied when they did it IN A PRIVATE PLACE... not in a PUBLIC VICINITY.
