    Mayor vetoes what he signed

    CEBU City officials were surprised to learn yesterday that Mayor Michael Rama signed and approved the controversial ordinance that seeks to protect the South Road Properties (SRP), which he repeatedly said he would veto.

    But no one seemed to be more surprised than the mayor himself.

    Rama admitted he was shocked when he saw yesterday noon his signature on the last page of the five-page ordinance, which he appears to have unknowingly signed last Aug. 1.

    In his news conference before noon yesterday, he told reporters that he still has to
    write a veto message.

    Realizing that there has been a mistake, he quickly wrote a veto message and submitted it to the Sangguniang Panlungsod (SP) secretariat shortly before 5 p.m. yesterday.

    He immediately ordered the city administrator and his staff to investigate how he ended up signing the document.

    ?We have to find out how this happened. I was surprised that it was signed because I have always said that there will be a veto? Basin naay nagkiat ang agi ani? What?s important is that there?s now a veto message and it?s already with the SP,? Rama told Sun.Star Cebu last night.

    He explained that a huge number of documents, with footnotes on what it is about and his required action, reach his table every day. The ordinance, he said, may have been mislabeled.

    Members of the City Council were quick to criticize the mayor for his ?negligence? and the ?embarrassing? situation he caused, since it appeared that Rama signed a document without even looking at it.

    It also raised questions on what document would take effect, whether it?s the signed ordinance or the veto message.

    ?I?m so embarrassed that we have a mayor like him. He totally made a fool of himself? it?s a reflection of how he?s handling the city,? Vice Mayor Joy Augustus Young said.

    For the vice mayor, the ordinance is good as approved because it already has the signature of the mayor.

    As for the veto, he said: ?We?ll just note it, then we?ll send it back to him and tell him, ?Sorry, it?s too late?.?

    In a phone interview last night, Rama said he will leave it to the council to tackle both the ordinance the veto message, adding that he trusts his allies in the council to defend his veto.

    The ?Ordinance protecting the South Road Properties and its stakeholders from unlawful and unauthorized transactions and dealings? was proposed by Councilor Noel Wenceslao.

    The council approved it during the session last July 18.

    Since then, Rama made it clear that he would veto the measure, which is why Wenceslao was surprised that the mayor signed it.

    ?I suppose he was aware of his action. Otherwise, it means that he signed it without knowing what the document is about and that he was negligent in signing. Why would he sign it without reading it in the first place?? the councilor said.

    Wenceslao said he will check if the mayor?s veto message is reasonable. If it isn?t, he will lobby with the councilors to override the veto.

    In his veto message, Rama said the ordinance is unfair and oppressive on the exercise of the power of the chief executive on fiscal management, including the administration of government real properties, such as the SRP.

    He added that the ordinance is partial and discriminatory against the Executive Department, and alludes to investors as ?speculators? in the purchase of government properties.

    The ordinance has been perceived by the mayor and his allies as a tool of the Bando Osme?a Pundok Kauswagan (BOPK) dominated council to keep the Rama administration from selling SRP lots to fund his projects.

    The ordinance requires any city official or employee to get prior authorization, and not mere ratification, from the SP for the validity and legality of transaction involving the conveyance of SRP lots.

    As stated in the ordinance, city officials or employees are not authorized to sell, dispose, transfer or otherwise convey any of the SRP lots; advertise or publish for sale, disposal, transfer; invite for public bidding, negotiated sale or other mode of sale, disposal, transfer or conveyance; or transact in any manner to sell, dispose of, transfer or convey any SRP lot, without any approval from the City Council.

    Any city official or employee is also prohibited from buying, directly or indirectly any real estate or other property belonging to the City of Cebu.

    The ordinance was proposed following the Rallos heirs? attempt to take over some SRP lots that were sold to Filinvest Land Inc., as the City?s payment for their property in Barangay Sambag 2 as road right-of-way.

    rama loves to talk and sing bisan gatamala lang ug pirma sa ordinansa..unya reklamo dayon bisan klaro nga sayop na cya..Attention Mike: taronga pud ug basa oi, u can designate ur own people to countersign any document first before u finally signed and approved..thats simple management lang oi, u are a lawyer by profession.. u should know it in the first place.. uwaw pud ta ani dah!

    mas mulambo ang cebu kung ang mga leader dli mag sigeg sumpaki. pala-away kau si tom.
