and yes i have read both the Regional Trial Court decision and the Supreme court decision (papers released and available in public), read it cover to cover.
Di ko taga Cebu, so the time this case was happening, i can only hear this in the news, I arrived in Cebu 2000, so naa na sa mga part na padung na human ang kaso.
Still there are questions unanswered.
1. Where is Jacquilene? not even the star witness know or have an idea, if he is indeed knowledgeable on the happening of the event, he might have heard from his crew/friends or barkada where Jacqueline is. All the court papers, state witness sworn affidavit and even investigation's story is only upto Marijoy's death.
Rusia (statewitness), investigators and Prosecution cant give a hint or idea where she is, (the proof of proving the guilt of the accuse is with them).
2. Why did the authorities stopped looking for Jacqueline?
3. What was the basis of the initial arrest of Paco and the group? given Russia came out 6 months after their arrest, what was the physical evidence that lead authority to Paco and 7 accused? one thing and one thing only, Mrs Chiong suspected Paco because in her words, he was a stalker of the sisters, but there was no strong evidence that should be the basis of their arrest, or perhaps not letting them bail on the initial arrest.
4. in the decision written by the supreme court, they were basing their final decision on the physical evidence, aside from the body of Marijoy which was only identified by a single slab of skin in the fingerprint, there was no other mention of physical evidence, No DNA testing, no circumstancial evidence, the van was not even recovered or presented in the case, all the evidences stated was the witnesses.
This is not the case that you can say na solved 'beyond reasonable doubt'
