    CEBU, Philippines - After being sued over the unreturned government vehicle, Labangon barangay councilman Rodulfo Tabasa has turned the tables on Cebu City acting mayor Margarita Osmeña by filing criminal complaints against her for his alleged unlawful arrest last week.

    Yesterday, Tabasa lodged complaints for unlawful arrest, kidnapping, and serious illegal detention against Osmeña and seven others before the Office of the Ombudsman-Visayas.

    Also included in the complaint are Ronald Malacora, General Services Office special assistant, GSO personnel Kenneth Amar and Rafael Cabonilas, city policemen, and three unidentified people.

    Tabasa said his constitutional rights were violated when he was detained without being apprised of what crime he committed.

    He said a man wearing police uniform and some civilians told him to go with them to the City Intelligence Branch office but he refused and asked them to present any arrest warrant.

    The men then forcibly brought him to a waiting vehicle, he added.

    When they arrived at the CIB office, Tabasa was told that he was already under arrest for carnapping.

    “I felt so scared and that my rights have been violated. I felt dizzy and my heart palpitated so fast,” Tabasa said.

    “I felt so stressed out, dazed. I was not able to sleep. I felt so violated. I cannot understand why am I detained when I did nothing wrong and that there was no case filed against me,” he added.

    Tabasa is one of the 47 barangay officials Osmeña sued for failing to return city-issued vehicles in line with Osmena’s order last month.

    But the councilman insisted that he didn't receive the memorandum.

    Tabasa was freed from detention only after Judge Pamela Baring-Uy ordered his release on June 11.

    One of Tabasa’s lawyers, councilor-elect Jocelyn Pesquera, said they have yet to identify the four policemen.

    "Ang atoa diri kay Office of the Ombudsman man kay they can take into account both criminal and administrative as government officials," she said.

    Pesquera said that upon confirmation with City Intelligence Bureau, Amar admitted that they were under the order of Osmeña and Malacora.

    "I interviewed him (Amar). I ask upon whose orders ni nga ni-effect man siya'g arrest without any charge in the court mao na nga iya nang gi-mention nga ang gasugo kay si Malacora ug ang acting mayor. Iyaha gyung gi-mention," Pesquera said.

    Osmeña, for her part, said she welcomes the complaint.

    "Okay lang, let them. Whatever they think what they have to do. I cannot stop them," she said.

    Last May 17, Osmeña issued memorandum recalling all city-issued vehicles for an inventory.

    In a separate development, she said yesterday the city plans to assign the HiLux vehicles from the barangay captains to the city’s department heads.

    "We were thinking, maybe this HiLux, we can give it to the department heads so that no more RATA (Representation and Transportation Allowance)," Osmeña said.

    She said the transition team found out that some of the department heads are getting RATA and are using the city-issued vehicles at the same time.

    The rule, she said, is that once an employee is given RATA, he should no longer have a service vehicle.

    City officials who do not have service vehicles receive a RATA of P18,000 a month
