We have a similar situation in the village . We have a tenant who has a business na gi homebased niya ang office which is a courier/delivery business . The neighbors petitioned kay samok daw and association officers agreed to deny the owner to operate business . There is no such thing as a law that bans people to operate business as long as you are permitted with it along with other documents needed .

As a landlord , I countered it with a petition also of shutting down all the sari sari stores , Globe/ Smart load and other practicing proffessions who displays their karatula na " NOTARY " , " LAWYER " , " DOCTOR " etc . The bottomline and point is , its the BUSINESS ...not the NATURE of the BUSINESS and who these BUSINESSMEN/WOMEN are .

Back to the topic .... its the NATURE of the HAZING and not the FRATERNITY . If MIRIAM SANTIAGO is really suggesting that she is really that smart , she should shut down also ORGANIZATIONS that are not GREEK LETTERED who engages in HAZING , apila na ang KNIGHT of COLUMBUS pod .

But if she is making a point of HAZING na nakapatay tungod kay grabe ang injuries gi inflict , then go after the responsible fraternity , master initiator . 3 words for you Madam Santiago ... HUBAGANG ATE OI !!

It is true that the people have the right to form unions, associations, or societies only as long as these are not contrary to law. [Section 8, Article 3: Bill of Rights, 1987 CONSTITUTION OF THE REPUBLIC OF THE PHILIPPINES].

But isn't it also a basic human right for individuals, such as the late Cris Anthony Mendez and others like him, not to be deprived of Life and Liberty? [Section 1, Article 3: Bill of Rights, 1987 CONSTITUTION OF THE REPUBLIC OF THE PHILIPPINES].

Which basic human right that should be protected more?

The right to assemble?

Or the right to live and the right to NOT have one's will become subordinate to others (and so-called 'noble traditions'), to be forced to subject oneself to torture?

We have no arguement wahtsoever. My point is she cannot BAN any organization period. The best thing the lawmakers can do is beef up their drive against hazing and that's about it, nothing more.

I am even appalled why universities and colleges can even refuse an individual to enrol when he or she is a member of a fraternity or a sorority.

@LytSlpr, my overall point is "Things CAN change". Right now, the law says fraternities have legal rights. That is the current status quo, but that can be changed.

It is not yet a criminal act to join or be a member of a fraternity or such societies. Some fraternities are just "branded" as violent groups but these are just labels and have no legal basis or repercussions.

Hypothetically, once legislation is passed and approved against the fraternities, deeming these as organizations to be held accountable for the illegal activities of their members (i.e. manslaughter through hazing), then there will be enforcement of this law by the police and the public prosecutors.

Anyway, all again~ hypothetical. Besides again not all fraternities are bad or engaged in the criminal activity of hazing. [b]There is already legislation banning the practice of hazing but this is still being practiced. Declares a lot on the type of people these fraternities take in as members, doesn't it? Or on the fraternities that take in such people as its members and leaders...

using your analogy, makoy, if we try to prevent car accidents, shouldn't we also try to prevent hazing activities?

[color=navy]Of course it is a solution. A simple one, and perhaps it can be effective. It's simple logic naman eh. But to say it is the only solution, that is another matter.

Abolishing fraternities to prevent further violations to the hazing ban is just one way to make sure nobody dies of hazing again, simple and quick~ but can it be accomplished? Again, subject to debate in this thread.

Preventing hazing is more appropriate than abolishing fraternities. Such a move just shows how incompetent our government is... as usual.

then again, the anti-hazing law has not been successful. shows us that many fraternity people are into hazing jud. so ban the fraternies and we won't have problems na with hazing
