    call another lawyer, escalate the case to higher court. wala palay labot sa bribery whatever daog nka daan. supporting documents that prove ownership imong alas sa caso.

    Hi, and thanks to all for their advice and input. When I first posted I should have said the MTC court not the RTC. We have now appealed and the case now goes to the RTC. As long as we get a different Judge we should be OK. The extent of the squatters argument is that he has lived on our land for a long time with no problem and has a receipt for 25 pesos for Barangay Tax, that is all he has. We only found out that this was our land when it was surveyed before we bought it. We asked him to move at that point, then while we were away he built another bigger house. He was the Barangay captain at the time, so we guess he thinks he has more power than us and can do as he likes.

    uhm, naglibog ko ts. Pagpa survey ninyo napalit nani ninyong yutaa? Wa man sad gud ko kabalo sa facts regarding sa inyong kaso ts, but na intriga lang ko sa decision sa judge ngano gi paboran ni xa na to think brgy tax ra iya gigunitan. However, naka puyo naman kaha ni xa for 25 yrs before ni ninyo napalit?

    TS, just want to ask if prompt ba inyo payments for real property tax?. i've read an article w/c said,

    Will I be penalized if I failed to pay my RPT and SEFT?

    "Yes. Failure to pay RPT and SEFT is subject to a penalty interest of 2% per month but not exceeding 36 months. So if the RPT remains unpaid for 4 years or 48 months, the delinquent taxpayer will only pay a penalty of 2% per month for 36 months.
    In addition, the local government unit can also foreclose your real property and sell the same in public auctions. The proceeds of the sale will be used to pay your RPT and SEFT including all interests and charges thereon. Any excess will be turned over to you. At the public auction, you can participate and bid to purchase your house and lot. If you offer the highest bid price, you will be declared the winner. Forthwith you will be required to pay the bid price to the local government unit. Upon payment and settlement of your tax obligations, title to the house and lot will be returned back to you.

    an excerpt from PD no. 464,
    "It shall also state that, at any time, before the seizure of personal property, payment may be made with penalty in accordance with the next following section, and further, that unless the tax and penalties be paid before the expiration of the year for which the tax is due, or the tax shall have been judicially set aside, the entire delinquent real property will be sold at public auction, and that thereafter the full title to the property will be and remain with the purchaser, subject only to the right of delinquent taxpayer or any other person in his behalf to redeem the sold property within one year from the date of sale."
