Fr. Belciña seeks inspection of ‘rape’ scene

Submitting his sworn statement and the affidavit of 11 other individuals, Fr. Jose “Joey†Belciña yesterday asked for the dismissal of the rape complaint an 18-year old college student filed against him.
In a six-page affidavit prepared by lawyer Gloria Lastimosa-Dalawampu, he also moved that the scene of the alleged crime be inspected, if only to show how baseless the charges are.
“In my whole life, I have never been charged with any crime or infraction of law, even those remotely associated with any amorous relationship with the opposite ***, but now I stand respondent in a criminal complaint for rape,†Belciña said.
Human nature
He pointed to allegations that “defy human nature†in the affidavit of the complainant, who said that she was first raped last July 22, 2005 but admitted to visiting the convent after and was even seen attending a birthday party with him and other church workers a day after the alleged incident.
The second rape allegedly happened last Dec. 25, 2005, but Belciña said the girl kept on returning to the convent until the third alleged incident of last Jan. 29.
“If it were true that I raped the complainant on July 22, 2005, her natural reaction would have been to avoid me thereafter. In fact, a victim’s reaction would be to refuse being seen with the alleged molester, but she didn’t,†he said.

After the complaint was filed with the Danao City Prosecutor’s Office last month, Belciña took a leave from his parish of St. Francis of Assisi in Maslog, Danao.
Of the 11 supporting affidavits, one comes from a priest, one from the girl’s boyfriend, and the rest came from her fellow working students of the St. Francis of Assisi Parish.
The Office of the Danao City Prosecutor has scheduled a clarificatory hearing next month.
In the meantime, a copy of the counter-affidavit has been submitted to the Legal Alternatives for Women (Law) Inc., through the Provincial Women’s Commission.
Dalawampu, in an interview yesterday, said they did not include a political angle in the counter-affidavit, upon the request of the priest.
The priest’s supporters had claimed that the charges against shim stemmed from his opposition to the Danao City Hall’s plan to put up a landfill in Barangay Maslog.
Dalawampu also brushed aside allegations that her defense of the priest is a betrayal of her oath as a women’s rights advocate and as president of the Federacion Internacional de Abogadas.

“Yes I am an advocate of women’s rights. But does that mean that I need to abdicate from my responsibility as a lawyer to defend my clients against charges that I know to be false?†she argued.
In his affidavit, Belciña said that last July 22, he was in a choir practice while members of the Youth Bible Sharing group were having a bible study at the parish pastoral hall that is not even a meter away from his bedroom, the alleged crime scene.
He submitted the affidavits of the choir leader, Leo Gala, some choir members, some church employees and working students.
As to the second incident, Belciña submitted a medical certificate showing that he was operated on the knee for a torn ligament and was only able to walk without crutches last Dec. 27.
Even then, he said, the doctors removed the braces from the ankle to the groin last January only.
Besides, the priest said, Dec. 25 was a “festive†day at the convent. He said they had their Christmas party that lasted until 1 a.m. of the following day. The girl was there, he said, and even won some prizes in a raffle.
As to the Jan. 29 incident, Belciña said he was attending a conference with Rev. Reynaldo Cui that, he said, ended about 10 p.m. The girl had said that she was raped around 8 p.m.
Support
Cui, some church workers and other working students issued affidavits supporting Belciña’s statement.
Belciña narrated that the complainant showed “some physical attraction†towards him before she came out with the rape charge, and that he “dismissed it as an infatuation or crush.â€
One Justin Macalolooy, who said he was the complainant’s boyfriend, also executed an affidavit that the girl had often shared to him how she was frustrated with the priest for being a “snob.â€

...then i believe in time he will be acquitted.
personally, granting his claims are true, it makes logical sense.
IMO base on the stories... the priest has a very strong defense.
