    What about the "nabayran" issue?

    this is what i mean of bad management, even police dont have the right nga mo dapat sa nakasala, maximum tolerance gyud na dapat not until ang suspect is armed and dangerous thats the time mo engaged ka physicaly but no to kill but only defend your self and to control the suspect..

    deli man cguro nah mao gi tudlo sa mga police og sa mga security guard nga kulatahon aron mo tagam.... hinambog naman nah nga pa agi..

    CCPO lets NBI assume probe on killed shopper

    THE City Intelligence Branch (CIB) of the Cebu City police released yesterday morning the security camera operator of a department store, a day after arresting him for allegedly mauling to death a shopper.

    This, after the Cebu City Police Office (CCPO) decided to forward the case against 31-year-old Jeffrey Aquino, the Gaisano Metro-Colon security camera operator who allegedly mauled to death Mario Alfie Ducayag, to the National Bureau of Investigation (NBI) 7.

    Two security personnel of Gaisano Metro-Colon issued affidavits identifying Aquino as the one who allegedly mauled Ducayag. Ducayag was taken in for questioning by Metro Gaisano-Colon security personnel on suspicions he stole a pair of slippers on April 12.

    CCPO Director Mariano Natuel Jr. said in a phone interview that the CIB will forward the evidence they gathered to the NBI 7 because Ducayag’s family wanted the bureau to handle the case.

    The NBI 7 would not have minded if the CCPO will continue to conduct a separate investigation on the case. NBI 7 Director Antonio Pagatpat said Aquino’s arrest will not affect their investigation.

    Ducayag’s family asked the NBI 7 to investigate after Dr. Nestor Sator of the PNP Regional Crime Laboratory said Ducayag died of asphyxia as a result of pulmonary tuberculosis. Sator, however, did not rule out foul play.

    Metro Gaisano-Colon chief security officer Mauricio Abella Doblados Jr. and house detective Melvin Manango Boyles executed an affidavit before the CCPO yesterday to the CCPO yesterday.

    Handcuff

    Boyles said Aquino was told by Doblados to handcuff Ducayag after the latter allegedly failed to present the receipt for a pair of slippers, which was among the things he bought from the store.

    Boyles said Aquino obeyed but Ducayag resisted. Aquino allegedly kicked and punched Ducayag until he was weak.

    But even after Ducayag was handcuffed, Boyles said, Aquino still kicked the other man in the stomach.

    In his affidavit, Doblados said he told Aquino to stop, but the latter allegedly continued to hit Ducayag.

    “I noticed that Mario Alfie (Ducayag) was gasping for air and had difficulty breathing while lying on the floor,” Doblados said, adding that he told Aquino to help Ducayag.

    Charges

    Aquino declined to speak to the media yesterday.

    Pagatpat said that the NBI 7 will find appropriate charges against the perpetrators once it has gathered enough evidence. He added that they will also invite Doblados and his staff for questioning.

    The police arrested Aquino at work in the store last Sunday morning.

    Mary Shanytlle Ducayag said her family is only “50 percent happy” as they believed that Aquino was not the only one who mauled her brother.

    The Metro Retail Group, in a statement, asked the NBI to deepen its investigation.

    Dig

    “With the arrest of Aquino and the statements of Doblados and Boyles, we urge the NBI and the police to dig further to get a full picture of the incident. And bring those responsible to justice and clear the name of those who had nothing to do with the
    incident,” said Metro Gaisano spokesperson Cerwin Eviota.

    After a separate autopsy, NBI 7 medico legal officer Dr. Rene Cam said Ducayag’s lungs showed bruises and signs of congestion, while his left lung collapsed. He said Ducayag probably tried to fight his captors as indicated by the bruises in his palms, right
    shoulder and chest.

    The NBI 7 earlier said the footages of the store’s security cameras showed that Ducayag was accompanied by Metro Colon security personnel.

    Pagatpat said the NBI will continue to investigate Ducayag’s death, even though the findings of the Cebu City Police Office seem to align with those of the bureau.

    “Ang lahat ng ito ay para sa hustisya (We are all doing this to ensure justice),” he told reporters.

    Consolidate

    He said that it is up to the prosecutor to consolidate the findings of the police and the NBI 7.

    Lawyer Bernard dela Cruz, supervising agent of the NBI team investigating the case, commended the police for Aquino’s arrest.

    “We could not prevent them from filing the case since we have one objective,” he said.

    “I just hope all the important evidence is preserve and (that there would be) enough evidence as well. I congratulate the police for the breakthrough.”

    Meanwhile, Integrated Bar of the Philippines (IBP)-Cebu City chapter president Mary Elaine Bathan criticized what she suspected was an attempt to cover up the truth behind Ducayag’s death.

    She said over radio dyLA that the IBP is willing to help the Ducayag family.
