people should stop using the tag "midnight appointee", everything pass through legal process. The problem was during that time Justice Carpio (Penoy loyalist) didnt include his name on the JBC list. If so he would had been elected cause of the seniority rule.

Also,many of the anti-GMA legislators already dropped the issue that the GMA "midnight appointee" was illegal--because if it had not been done the JBC would be in ruins, and there is no way for PNoy to appoint another CJ or other AJs without amending the constitution. Which cannot be afforded because of the time it tokes to scrutinize the issue, in the event that any of the 14 seats in the SC is to be vacated.
