Doc stands by asphyxia findings

DR. NESTOR SATOR, medico legal officer of the PNP Regional Crime Laboratory, stands by his autopsy findings that one man’s death inside the Gaisano Metro was caused by asphyxia.
The National Bureau of Investigation (NBI) re-autopsied Mario Alfie Ducayag, 23, and found that the latter’s cervical vertebrae were dislocated, which contradicted Sator’s first autopsy report.
Sator, in his autopsy, said Ducayag’s death may have been caused by asphyxia due to pulmonary tuberculosis. Asphyxia is the lack of oxygen or excess of carbon dioxide in the body. Sator did not rule out foul play.
But in the NBI 7 autopsy result, Ducayag’s lungs also had congestion and bruises, while his left lung collapsed. The NBI 7 thought Ducayag probably fought back against the persons who mauled him as he had bruises in his palms, right shoulder and chest.
Sator admitted he did not notice any dislocation during his autopsy.
“My result was based on what I’ve seen during my autopsy with him (Ducayag). We, medico-legal officers, have the same guiding principles and I do not have any intention of course of changing my autopsy report. Kung unsa to ang resulta, base rato sa akong nakita,” explained Sator.
He added that he respected the result of the second autopsy conducted by Dr. Rene Cam of the NBI 7, but he said his autopsy result was not wrong because he based it on what he saw on Ducayag’s body.
“I just did my part. The important thing is that you conduct the autopsy the proper way,” added Sator.
He added there might be also some factors that might affect or changes the result of the second autopsy considering the body has already been open during the first.
When asked about the family of Ducayag, who might be filing charges against him, Sator said he will respect the family’s decision.
“Wala koy gilabanan kay wala man ko kaila sa mga concerned parties para lainon nako ang resulta. I also explained to them (Ducayag’s family) about the result of my autopsy (I’m not siding with anyone to alter the results),” added Sator.
Error
For his alleged erroneous autopsy report, Sator will be charged by the family of a Ducayag who died inside Metro Gaisano on Colon St., Cebu City after he was investigated by the security personnel.
“Wa gyoy sakit akong manghod (My younger brother has no illness),” said the victim’s sister Marie Shantylle in a phone interview. “We believed he was mauled.”
When asked by reporters if there was foul play involved, Cam said: “With this finding, we can really say that.”
Commission on Human Rights (CHR) 7 Chief Investigator Primo Cadampog said they will also look into the incident.
“We should value the dignity of a human person,” he said. “You cannot compel a person to tell the truth, who has the right to remain silent.”
Meanwhile, Metro Gaisano’s vice president for marketing Cesar Jose Jesena, store manager May Sasedor and other officials visited the NBI yesterday afternoon.
“This is to demonstrate that we will be cooperating,” said the mall’s spokesperson Cerwin Eviota.
Dislocated
In the NBI’s autopsy, Ducayag’s cervical vertebrae were dislocated, and he had bruises in his palms, right shoulder, chest and his back.
“There was sufficient force applied at the back of the head,” said Cam.
He further said the victim’s lungs also had congestion and bruises, while his left lung collapsed.
NBI 7 Director Antonio Pagatpat said there is no reason to conduct lie-detection test on the mall’s personnel who are being investigated.
He said Ducayag was collared by the security personnel in the presence of other employees.
“We are vigorously pursuing the investigation,” said Pagatpat.
Cam said they will use their autopsy report when they will file the complaints against
the culprits.
“The second autopsy has more findings that really explain the death,” he said.
Security guards Margie Gacer and Cesar Celerio, chief security Mauricio Doblados, security camera operator Geoffrey Aquino and other personnel are under investigation for their alleged role in Ducayag’s death.
The guards are suspended pending the outcome of the investigation.
