MANILA, Philippines (UPDATED) - The Sandiganbayan has issued an arrest warrant against former President Gloria Macapagal Arroyo and her husband Mike in connection with the junked National Broadband Network deal.
Lawyer Ferdinand Topacio confirmed the news. Arrest warrants were also issued to former Transportation Secretary Leandro Mendoza and former Commission on Elections Chairman Benjamin Abalos.
Topacio said his client, the former First Gentleman, “is ready to turn himself to the jurisdiction of the Sandiganbayan.” He said they will post the necessary bail.
In separate motions filed earlier, both Arroyo and Mendoza said there is no basis for the arrest because the deal was already rescinded.
They said the case filed by the Office of the Ombudsman was based, therefore, on a non-existent contract.
The Office of the Ombudsman filed graft charges against them last week for supposedly exerting influence for the approval of the NBN-ZTE project.
The former First Gentleman cited the case of Henry Go vs. Sandiganbayan, where the Supreme Court ruled that a private individual cannot be held liable for a supposed violation of Section 3(g).
They added the deal was a government-to-government transaction. Thus, it was insulated from direct or indirect influence from private parties.
Topacio said they have also asked for oral arguments on the matter.

MANILA, Philippines – Former First Gentleman Jose Miguel “Mike” Arroyo posted bail after the Sandiganbayan issued a warrant for his arrest in connection with the graft charges filed against him and several others.
Arroyo, who was accompanied by lawyer Ferdinand Topacio, posted P30,000 bail before the 4th Division of the Sandiganbayan shortly before 2 p.m.
The Sandiganbayan earlier also issued warrants to former President Gloria Macapagal-Arroyo; former Comelec Commisioner Benjamin Abalos; and former Transportation and Communications Secretary Leandro Mendoza in connection with the junked $329-million National Broadband Network deal.
Arroyo did not have his mug shots taken anymore after he provided the court with his own photos.
The former first gentleman also expressed surprise that the court issued the arrest warrant, even if the court has yet to decide on their motion for judicial determination of probable cause.
He also insisted that the Sandiganbayan is not the proper court to handle his case, saying he is not a government official.
The police, meanwhile, is also on its way to serve the warrant of arrest for Mendoza at his residence in BF Homes, Parañaque.

MANILA, Philippines - Former President Gloria Macapagal Arroyo has called on Filipinos to “pray hard” for unity in the country.
In her birthday and Easter message, Arroyo, who is on a hospital arrest, said she hopes that “the divine providence protect our country and all Filipinos from any calamities, disasters and hardships that may come our way. Sana po ay mawala na ang kaguluhan at kalungkutang likha ng hindi pagkakaisa.”
Arroyo is facing electoral sabotage charges for her supposed links in the widespread fraud during the 2007 elections.
The Aquino government has been on her heels ever since she stepped down from office. The current administration is alleging widespread corruption during her term.
“It is my fervent hope that we will be truly united in the pursuit of long lasting happiness and prosperity. Let us pray so hard that wounds will be healed soon, with faith and resolve to help one another and move as a nation towards a brighter future,” Arroyo said.
Arroyo will turn 65 on April 5, Thursday. A mass was held at the Veterans Memorial Medical Center today.

MANILA, Philippines – Former President and now Pampanga congresswoman Gloria Macapagal-Arroyo, her husband, Jose Miguel, and former Commission on Elections chairman Benjamin Abalos Sr., pleaded not guilty to graft charges filed against them over the botched National Broadband Network (NBN) deal with Chinese telecommunications firm, ZTE Corp.
Arroyo had her arraignment before Judge Gregory Ong of the anti-graft court’s fourth division at 8:30 a.m.
The former president likewise entered a not guilty plea to a charge of violating the Code of Conduct and Ethical Standards for Public Officials and Employees.
The Office of the Ombudsman earlier declared the cancelled NBN deal overpriced, and anti-graft prosecutors filed the charges against the Arroyos and her co-accused last December.
Former Department of Transportation and Communications Secretary Leandro Mendoza, who is also one of the co-accused, did not attend the arraignment as he has yet to recover from a stroke at the St. Luke’s Medical Center in Taguig City.
Mendoza’s lawyer, Atty. Alexander Poblador, asked the court to move his client’s arraignment to May 14.
The court agreed not to require Arroyo and Abalos to attend the pre-trial conference on June 4.
Arroyo and Abalos are currently detained for allegedly participating in the rigging of the 2007 senatorial elections.

MANILA — Philippine prosecutors filed a non-bailable corruption charge Monday against former President Gloria Macapagal Arroyo, which she said was aimed at ensuring she remains in detention as she fights to be released on bail in a separate vote-tampering case.
Arroyo’s camp described the filing of new plunder case against her as another "dark day for the rule of law."
The Office of the Ombudsman filed with Sandiganbayan a P365-million ($8.7 million) plunder suit against Arroyo and nine other former officials of Philippine Charity Sweepstakes Office (PCSO) and the Commission on Audit (COA) for alleged misuse of PCSO's Confidential/Intelligence Funds (CIF).
The case stemmed from two separate complaints – one filed by Jaime Regalario, Risa Hontiveros-Baraquel and Danilo Lim on July 25, 2011 for plunder, malversation and violation of Republic Act 3019, or the "Anti-Graft and Corrupt Practices Act"; and another complaint dated November 29, 2011, filed by the PCSO itself represented by Eduardo Araullo, for plunder and violation of RA 3019 -- for the respondents' acts of purportedly amassing millions of pesos by diverting funds sourced from the CIF during the latter years of the Arroyo administration.
