    i heard the news that the Suprmeme Court has already decline trillanes special treatment of being out of jail during senate sessions. but the legislature is trying to make a Resolution, and accumulating most of it from the opposition to possibly reverse the decision of the Supreme Court. in my opinion, being co-equal and with adherence to the separation of powers, they should respect the decision of the Supreme Court.

    MANILA, Philippines -- The Makati City regional trial court (RTC) dismissed for lack of merit a petition by Senator Antonio Trillanes IV, who is facing coup d'etat charges, to be allowed to attend sessions, and to set up office and grant interviews in his Fort Bonifacio detention cell.

    Likening Trillanes' case to that of former congressman Romeo Jalosjos, who was elected into office despite being convicted on child rape charges, the court, in an 11-page ruling, said his election did not afford him special privileges.

    "Such an aberrant situation not only elevates accused-appellant's status to that of a special class. It would also be a mockery of the purposes of the correction system," Judge Oscar Pimentel of the Makat RTC branch said, quoting from the Supreme Court ruling that denied Jalosjos' motion to attend House sessions.

    Trillanes, one of the alleged leaders of a short-lived mutiny on July 27, 2003, placed 11th in the race for 12 Senate seats in the May 14 elections on the strength of over 11 million votes.

    Like the Jalosjos case, Pimentel said voters knew of Trillanes’ pending cases before the Makati court when they elected him to office.

    Trillanes is also charged with violation of Article of War 96 (conduct unbecoming an officer and a gentleman) before a general court martial for allegedly leading 300 junior officers and soldiers in the uprising.

    The court also cited a letter from Armed Forces Chief of Staff General Hermogenes Esperon Jr., who said a "political office" could not be set up inside military camps since it could "politicize" the ranks.

    In the letter, Esperon asked the court to clarify whether or not Trillanes should remain under military custody. The Senator is detained at the Philippine Marines brig in Fort Bonifacio.

    Esperon reiterated this argument, when sought by reporters for comment on the court ruling.

    "[The decision] goes with my reasoning that he should not be allowed [to hold office while in detention] because of his office," he said.

    Esperon said Trillanes' supporters voted for him knowing that "he has a handicap in performing his duties."

    Trillanes’ lawyer, Reynaldo Robles, did not answer calls on his mobile phone when sought for comment.

    now the court has spoken, i knw nga naa pai appeal but jst hoping DLI MABALI sa higher court.
    let him have his sentence first before he will serve.

    At least, the court has already spoken. Indeed, it will be a mockery if he will just be freed because he won. Otherwise, we can just let this be another example for our criminals to find their way to popularity and win a public office so as to escape penalty.

    Of course, Trillanes' camp will appeal to the higher court regarding the matter. I really hope the decision will give justice and equity to all of us.

    ^^ the court has already spoken indeed but,senate is filing and soliciting a resolution among them to reverse the court's decision. hhmm...

    this would be another issue. let them just respect the decision of the court.

    MANILA, Philippines -- The Makati judge gave little credence to the vote of the more than 11 million Filipinos who elected military rebel Antonio Trillanes IV to the Senate.

    In a sweeping denial of all of Trillanes’ pleas, Judge Oscar Pimentel Monday rejected Trillanes’ motions to be allowed to attend all official Senate functions, to be given access to media and to set up an extension office inside the Marine detention center at Fort Bonifacio in Taguig City.

    Pimentel upheld the prosecution claim that the Department of Justice, “as the prosecuting arm of the government, its shield and sword of law and order, represents not only the 11,138,067 voters who voted for him (Trillanes), but the people of the Philippines, with all its 85 million citizens and counting.”

    The ruling came five days after the Senate, by an overwhelming 17-4 vote, passed a resolution in favor of allowing Trillanes to attend Senate sessions.

    ^^^ court order will still be followed. so kng dli lang balihun sa suprime court ang decision then trillanes will remain where he is now.
