    Default BIR Revenue Ruling 11-2010

    Or the 11-2010.

I was wondering if RR 11-2010 has taken effect in any companies, particularly Regional Office Headquarters (ROHQ), in Cebu or anywhere else south?

This has been a thorn for us employees in Manila and there seems to be no escaping it.

In summary, the head of BIR has passed a ruling redefining Technical/Managerial employees of multinational corporations that are headquartered here in the Phils.

In summary this is what the ruling means:
    1) The 15% withholding tax will be increased to 30% IF your job category doesn't fit in with the "white boys" meaning dili ka specialized/technical/manegerial. Sila ra! Dapat raba daw ikaw ra kamao ana imo trabaho! Ingna kuno ko na DILI na sakit ang 30% withholding tax!
    2) If your annual gross compensation bracket falls below 900,000.00 you will be taxed at 30%!

Now, I have asked friends and family who work for NEC, Lexmark (kani I know is the ONLY one in the Phils), Timex and Tamiya and none of these people including their managers have heard of this ruling. So unsa man gyud ni? Our managers here claim it's nationwide but ngano wala man lagi apektado sa Visayas ug Mindanao?!

    Read the full ruling here:

Dia ra bai ang source RMC for ROHQ. RMC 41-2009 ftp://ftp.bir.gov.ph/webadmin1/pdf/4...%2041-2009.pdf

As I understand it, the Phils CURRENTLY taxes us at 30% if your annual gross income is less than 900k (so you may search existing Tax codes for this. I'm still looking.). Working for an ROHQ MNC gives us the benefit of a 15% w/holding tax as defined in the above PDF 41-2009. Since this new RR 11-2010 is now enforced it has literally "trimmed" off Filipinos back to the rest of the regular non-ROHQ status. Meaning we are no longer protected by this 15% tax privelege.

    BULLSH*T kaayo!
