    A HOMICIDE complaint was lodged yesterday against Medellin Mayor Ricardo Ramirez before the Cebu Provincial Prosecutor’s Office over the death of his close aide, Edelberto “Delbi” Abao.

    The Criminal Investigation and Detection Group (CIDG) 7 recommended the filing of the complaint against Ramirez, saying evidences investigators gathered were sufficient to haul the mayor to court.

    Edelberto, a casual employee of the Medellin municipal government, suffered a gunshot wound in the right leg. He died at the Severo Verallo Memorial Hospital in Bogo City last Dec. 27.



    Edelberto, 57, was the leader of the “mayor’s squad,” which is tasked to guard the town’s public market.

    Ramirez welcomed the filing of the charges against him, saying he now has a venue to clear his name.

    “Fighting in the newspapers was a losing proposition,” he said in Cebuano in an interview yesterday. “At least now, we can present our own witnesses and evidence.”

    Suspicion

    He downplayed the findings of the CIDG in Bogo, saying one of the witnesses is connected with the town hall, while the other is the dean of the criminology department of a local school that is owned by a municipal councilor.

    “I hope the witnesses who were coached to lie will realize the gravity of what they’ve done,” he said. “Definitely, I am going to file charges against them for providing false testimony.”

    He reiterated his suspicion that the case, which he said has “political undertones,” is a frame-up.

    Instead of falsely accusing him of murder, the police should try to find Edelberto’s real killers, he said.

    Ramirez anticipates the release next week of the results of a parallel investigation conducted by the Department of Interior and Local Government (DILG) and hopes the agency investigating the CIDG complaint will be furnished a copy.

    “The DILG conducted an honest-to-goodness investigation. They took my side, they interviewed people. I am more confident that the DILG was able to get a better picture. I am sure their findings will be different,” he said.

    “The CIDG never contacted me. They never even gave me an invitation,” he said.

    Admission

    PO3 Arnold Bucayong, CIDG 7 investigator, admitted to reporters they did not get the side of Ramirez in the course of their investigation and prior to yesterday’s filing of the complaint.

    Bucayong said they invited the mayor’s personnel to their office for their side but they did not show up. He said their decision to file the complaint was supported by evidence gathered by their investigators.

    The CIDG unit in Bogo headed the investigation, but Ramirez said they, too, have their own agenda.

    He said two CIDG operatives regularly demand money from the town’s fishing operators.
    DILG 7 Director Pedro Noval, in a separate interview, said the report will be out next week and a copy will be sent to the anti-graft office.

    Due process

    Noval said Ramirez will be afforded due process under the Office of the Ombudsman-Visayas.

    “It will be up to them to determine what the appropriate action to take shall be,” he said.

    The Provincial Government will also be given a copy of the DILG report, Noval said, adding that their fact-finding was non-partisan.

    Ramirez is an ally of Gov. Gwen Garcia in a congressional district identified with the Martinez family, a political opponent of the governor’s.

    “The coverage of the fact-finding investigation is the shooting only. We took the statements of everybody involved. All sides are represented, including Mayor Ramirez.

    We do not want to be labeled as biased,” Noval said.

    When word of the killing broke out, Ramirez was identified as a suspect.

    “Ninety-nine percent of his family, they all know that I am innocent,” Ramirez said, adding that only the victim’s son Edelito is saying he is guilty and that is because he has an axe to grind against the mayor.

    Text rumor

    Edelberto’s other son Kristofer rose in Ramirez’s defense, saying the family does not believe the mayor is the killer.

    Ramirez, in a previous interview, said he considered the victim as family.

    “We were friends,” he said.

    Cebu Provincial Police Office Director Erson Digal had described Ramirez as the “principal suspect” in Edelberto’s death.

    The basis for this is a rumor circulating through text messages accusing the mayor of shooting Edel-berto and the dying declaration that Edelberto allegedly gave Edelito.

    Digal said the victim’s companions on the night of the incident are also suspects.

    Ramirez had declined to undergo a paraffin test.

    He said he tested a gun on the day of the incident and was bound to test positive for gunpowder.

    Paraffin test is obsolete. Most developed countries no longer admit it as evidence. Kita na man lang guro nag gamit ana.

    Mau na ang sakto, file ug kaso aron patas sa tanan. Dili sa media lalison kay wa nay due process. Pinoy justice system, trial by publicity.
