    Default Is there a Breach of Contract? -comments pls.


    Hi,

    I have an officemate who was offered by a certain company here in Cebu. Now, he was only given a little time to decide whether or not to join there company. In other words, they're pressuring him to decide quickly else he'll lose the job. My officemate then replied via Email that he'll be joining them next week. After learning about the job offer, our current employer proposed to him a counter offer which made him decide to stay.

    Will there be a possibility of a Breach of Contract lawsuit here because of what we call "broken promise" (via email)?

    Unless your officemate signed the contract... but confirmation sa email raman kaha, so wala rana breach of contract. Uso man sad awol dire sa atoa, hehehehehe....

    I think wala, but pangayo lang ug pasensya, kay di pud lalim sa usa ka employer.

    no breach of contract but just apologize to the new company so that your friend can have another opportunity in the near future in the other company

    no signed contract so wala ra na...unless the whole transactions was made through email...kana magkaproblema mo...

    Hi thanks to your replies. As an additional info, in my officemate's email, he confirmed to join that company by next week.

    PS. Grabe pod maka=pressure tong manager sa pikas company. I'm not sure if it's their trick. He wants a decision to be made right away. as in, it's way beyond office hours. 9 PM, i think. That rude manager even threaten my friend to use his email and forward it in there legal dept. as an evidence.

    He Confirmed but it is still considered NOT CONFIRMED since he didnt sign the contract.

    There can only be breached of Contract if the contract was signed by both parties.

    Dili ka kamahay sa manager TS, labi kung urgent and position.

    Unless naai signed documents ( hard copy ) he/she should not worry.
