    Palace mediating in PAL labor row to avoid strike — PNoy

    While members and leaders of the Philippine Airlines Employees’ Association (PALEA) are holding a strike vote, Malacañang is trying to mediate between union and management in the hopes of averting a work stoppage involving around 3,700 workers of the flag carrier.

    In a media briefing Tuesday, President Benigno Aquino III said that Executive Secretary Paquito "Jojo" Ochoa Jr. is acting as arbiter between PAL workers and management.

    “Last night I was talking to the executive secretary, whom I tasked to talk with both PALEA and the PAL management, and my understanding — about a few weeks ago siguro — was that they were closer to resolving the issues," the President said.

    "[It] seems there have been some miscommunication, things that should have been transmitted to the other party were not done, so [the executive secretary] is taking care of that," Aquino said.

    PALEA said Monday it will hold a strike vote Nov. 7 to determine if the association could muster the numbers needed for a strike.

    The union said it expects around 3,700 members from PAL offices in Manila, the airports in Cebu and Davao, and outlying stations in 14 cities to take part in the strike vote.

    On Oct. 29, Labor Secretary Rosalinda Baldoz affirmed a March 2010 Department of Labor and Employment decision allowing PAL management to retrench 2,600 employees to streamline the airline’s operations

    The move cuts down PAL’s workforce to 4,000 and the Office of the President is still reviewing the decision of Baldoz.

    500 members of PAL union in Cebu to join strike vote

    Some 500 members of the Philippine Airlines Employees Association (Palea) based in Cebu will participate in a strike vote required by law so they can conduct a strike against the airline management.

    Gerry Rivera, Palea president and vice chairperson of the militant Partido ng Manggagawa, said the strike vote will be held Tuesday, and they expect to get the necessary majority support of their members.

    Philippine Airlines (PAL) on Monday questioned the legality and propriety of Palea's planned strike vote.

    In a statement, the flag carrier said Palea's notice of strike vote, which it filed with the National Conciliation and Mediation Board (NCMB), "is without basis".

    PAL stressed that the conditions that justify the holding of a referendum calling for a work stoppage are not present. PAL said Malacañang has yet to decide on the union's pending appeal for presidential intervention in the labor dispute between PAL and Palea.

    Palea leaders, however, maintain their notice of strike vote is in order.

    "The strike is in compliance with the requirements of the law. If management does not desist from harassing Palea members to avail (themselves) of the separation offer, which is tantamount to individual bargaining and therefore illegal, then we will be forced to actually hold the strike," Rivera said.

    "Management continues to violate its own promise during the mediation last Nov. 8, that PAL managers will refrain from discussing the issues with Palea members," he added.

    Rivera and other Palea leaders delivered a notice of strike vote to the office of NCMB Executive Director Reynaldo Ubaldo at 8:30 a.m. Monday, with a copy furnished to Labor Sec. Rolinda Baldoz.

    This means that Palea can proceed with the strike vote from 9 a.m. to 12 midnight Tuesday.

    As this developed, PAL assured its passengers that flights remain normal and continue to operate as scheduled.

    "A work stoppage does not happen overnight. PAL will exhaust all legal means to prevent any disruption that could hurt the economy and cause inconvenience to the riding public," PAL spokesperson Cielo Villaluna said in a press statement.

    While PAL management has received assurances from various PAL employee groups that they will not join any strikes, Villaluna said PAL has contingency measures in place.

    "PAL has made arrangements with sister airline Airphil Express and other local carriers to help carry domestic passengers, while PAL's 134 interline partners are also ready to lend a hand in our international routes. To ensure the steady supply of food and other amenities, PAL also made arrangements with several catering firms to supply meals," she said.

    Some 3,700 Palea members from all PAL offices in Manila, the airports of Davao and Cebu, and even in outlying stations in 14 cities nationwide will take part in the strike vote.

    "We don't make strike threats. We just do it when needed. That is why we are preparing the requirements for a strike, which will happen at the appropriate time. A majority support of members assessed via a strike vote is necessary to hold a legal strike," Rivera explained.

    Rivera said the strike vote does not constitute a transgression of the mediation efforts of the Office of the President.

    "We are not blackmailing Malacañang to favor our position but we are warning management about its illegal acts. It was Palea that asked for the intervention of President Benigno Aquino III into the PAL-Palea dispute, and so it is illogical that we will sabotage it," Rivera said.

    He clarified that the issue pending before the Office of the President is PAL's outsourcing plan, which has been affirmed by Baldoz.

    The strike vote, on the other hand, arose from the complaint against individual bargaining allegedly by PAL management, which constitutes unfair labor practice and union busting.

    "Conciliation talks before the NCMB remain pending and have not bogged down. In fact, it was upon mutual agreement by PAL and Palea to suspend conciliation meetings to allow the Office of the President to act on Palea's appeal to reverse an earlier ruling of Dole," Villaluna explained.

    Why is it so hard for the company to settle things out with their employee,
    tenure and just salary are responsibilities not a business strategy option.

    it's not just a matter of responsibility but profitability. if you've purchased a company that's been bleeding since day one up to 12 years and continuing, what would you do?

    While I agree that salaries should be commensurate to JD, we must also be reasonable and practical when running a business.
