    Joavan is off the hook; Soc in trouble



    CEBU, Philippines – Joavan Fernandez is now off the hook from his latest caper after an uptown mall security guard whom he allegedly threatened with a gun refuses to press charges.
    His father, however, Talisay City Mayor Socrates Fernandez is in serious trouble for allowing a government vehicle assigned to his office to be driven by unauthorized person and without trip ticket.
    The [COLOR=blue ! important][COLOR=blue ! important]Toyota[/COLOR][/COLOR] Revo, driven by Benedict Gabasa, which the members of Pardo Police intercepted in Barangay Bulacao Monday afternoon over reports that an armed group led by Joavan is on board, was assigned to the mayor's office of Talisay.
    Department of Interior and Local Government regional director Pedro Noval said Fernandez is liable for the unauthorized use of the vehicle assigned to him. Noval, in an interview over dyLA, said there are guidelines set by the Commission on [COLOR=blue ! important][COLOR=blue ! important]Audit[/COLOR][/COLOR] governing the use of government-owned vehicles.
    One of the basic requirements is the trip ticket. However, the Toyota Revo driven by Gabasa did not have a trip ticket. Gabasa, aside from being unauthorized, also did not have the driver's license.
    The police also recovered drug paraphernalia and Nubain ampules inside the vehicle.
    Noval, however, said the DILG could not investigate Fernandez without a formal complaint. He said it is the Office of the Ombudsman Visayas which has the authority to conduct investigation even without a complaint.
    Talisay City public information officer Arturo Bas said the vehicle used to be the mayor's service vehicle but is now entrusted to Joavan for the latter's feeding pro-gram, a project given to him by his father.
    Bas said Fernandez is now using a surplus vehicle, a [COLOR=blue ! important][COLOR=blue ! important]Kia [COLOR=blue ! important]Sportage[/COLOR][/COLOR][/COLOR]
    , as his service.
    The police already filed three criminal charges against Gabasa before the Cebu City Prosecutor's Office. The complaints include violations of Article 1 Section 19 of Republic Act 4136 otherwise known as driving without valid driver's license, City Ordinance 1427 which prohibits the use of Nubain and Section 12 of R.A. 9165 or illegal possession of drug paraphernalia.
    The prosecutor's office recommended P40,000 bail for drug paraphernalia while P5,000 each driving without license and possession of Nubain.
    Chief Insp. George Ylanan, chief of the Investigation and Detective Management Branch of Cebu City Police Office, said no charges were filed against Joavan because the security guard who earlier asked for police assistance is not interested to press charges.


    "Wala kay wala ma'y complainant. Di man mu-kiha ang security guard. Wala sad siya sa sakyanan mao dili siya ma-link sa drugs. Di man ma-hug nga inflagrante delicto," Ylanan explained.
    Roland Ruiz, security guard of Mango Square Mall, earlier complained that Joavan pulled out a gun and showed it to him. Ruiz claimed that Joavan got irked because he stared at him.
    The guard said he saw Joavan engaged in an argument with a foreigner at the vicinity of the mall prompting him to check. But, Joavan, did not like the way Ruiz looked at him.
    Joavan allegedly pulled out a gun and showed it to the guard before boarding the Talisay City-owned Toyota Revo with plate number SGH 541. The guard alerted the police prompting a hot pursuit [COLOR=blue ! important][COLOR=blue ! important]operation[/COLOR][/COLOR].
    The vehicle was intercepted in Talisay but Joavan was no longer in sight. Ylanan said a witness saw Joavan and a female companion alighted from the vehicle near Villa Bulsita in Bulacao.
