I remembered one incident before back when I was w/ ***** (callcenter) a Sup and a few agents were reprimanded and was terminated by the company but the Sup. proved he had nothing to do w/ the issue so nag hire sya ug lawyer and nagfile ug kaso sa DOLE. He than was proved innocent and the call center was fined (i think) to the tune of 6 figures.

basta kamao lang ka mobarog para sa imo rights I don't think having a union or not is really that important... IMO

    According to DOLE...

    Dear Sir/Madam:

Art. 243 of the Labor Code, provides that: "All persons employed in commercial, industrial and agricultural enterprises and in religious, charitable, medical or educational institutions whether operating for profit or not, shall have the right to self-organizations of their own choosing for purposes of collective bargaining. x x x"

Art. 245 of the Labor Code, provides that: "Managerial employees are not eligible to join, assist or form any labor organization. Supervisory employees shall not be eligible for membership in a labor organization of the rank-and-file employees but may join, assist or form separate labor organizations of their own.

We hope that this answers your queries.

and to think that our MANAGERS & HR officers deceived us by saying that it is ILLEGAL to put up a union in a multinational/EPZAs.

I also consulted a lawyer specializing in labor law and he confirmed this information.
Does Article 243 also applies to any Export Processing Zone (EPZ) or Business Process Outsourcing (BPO) companies in the Philippines? I think this companies have special privileges and rights of its own while they conduct their operations here in our country. Of course, they follow rules and regulations of DOLE in terms of employees compensation and work privileges. It would be a suicide for multi-national companies if they knew that labor unions are part of the agreement.
