my kuya, me and a cousin will be filing a case against a certain association regarding the lots they sold us. can someone enlighten me if naa ba mi grounds to sue.

we bought a 124sqm lot inside a subdivision sa pardo. we're currently paying 6700/month. ang sabot namo, if mkbayd na gani og half sa total price, pwede na tukuran. halfway namn mong payment, my husband and i plans to build a house na next year.

but this is what happen. the title declaration #posted sa among contract to sell is cancelled na daw. the title is under a new name na daw. so nakuyawan mi. my mom had the papers checked, daghan kaau clag permit na wa na-approve or wa pa na-approve. according to the seller/association, pwede nami mutukod og house. accrdng sa friend sa akong mom, pwede mukutod but at our own risk. wa pa gud na approve. basin haw-siao daw na seller namo. basin daganan lng mi ana. the seller has no permit such as the ff:
-permit to subdivide (the lot)
-permit from the environmental agency.
-etc.

we consulted a lawyer who issued a demand letter to the seller. the seller responded with copies of the title declaration, and copies of the deed of sale between the heirs of the lot owner and our seller. but no permits were shown and no new lot title presented to us. duda nako, wa pa gani na-balhin ang lot ownership sa mga heirs, gi-palit na sa seller/association which in turn they sold to us, even without the necessary permits. pwede ba na? pwede na grounds na mbalik among money?

since 2006 or 2007 pa gud na cla nag-collect of payment from their buyers then this year or late last year pa na cla ngdevelop sa sub-division. daghan pa gyud cla gi-promise na wa ntuman like width sa road, road to access the subdivision. basta, mkduda sad.

Try to ask HLURB burag sila dunay jurisdiction ana. Ask lang ko, kinsa diay imo developer TS?


Definitely you can go after them, diba you have all the documents to prove your payments.

Kanang 60 percent burag mu apply na sha kung in good faith ang developer, pero kung dili, burag they have to pay you in full.

Try to know kuno TS kung unsa jud reason ngano dili pa mo katukod.

And review your contract, kung klaro kaayo sila ni breach sa contract then naa jud moy habol ana.

Pero kung ang contract mismo ang defective, then filing a case is the best option siguro, i guess.
