Bolo should have revealed everything when he gave his "crying" speech. I don't think it's too late though; who knows, he just might name names and give juicy details of what really happened.

As I was saying in the other thread, this all boils down to a simple question - with all the supposed "bright minds" in the capitol, with all their lawyers, YET NOT ONE OF THEM THOUGHT TO DO A THOROUGH DUE DILIGENCE EXAM BEFORE PAYING P98 MILLION?

With the 2 "investigation" reports, now they compound their credibility problem - again, with all the supposed "bright minds" and all their lawyers, NOT ONE OF THEM THOUGHT OF DIGGING DEEPER into the issue.

It looks to me like capitol may just have dug themselves a deeper hole with their 2 whitewashing reports - if Tomas wins as congressman of the South District, he just might make good his threat of a congressional investigation into this scandal.

‘I acted on guv’s orders’


CEBU Gov. Gwendolyn Garcia should also be included if there will be criminal and administrative charges on the purchase of the Balili property, Provincial Board (PB) Member Juan Bolo said yesterday.


Bolo said he should not be singled out in the controversy saying he was only following Garcia’s orders.

Yesterday afternoon, Garcia filed a petition in court to ask the executor of the Balili estate to refund Capitol P38 million.
A committee organized by Capitol to look into the purchase recommended that Bolo be investigated for his “active and direct participation” in the purchase.
Bolo called for a press conference yesterday in his office at the Legislative Building to clarify his side after reading the full content of the report furnished to him by Capitol consultant Rory Jon Sepulveda.
Bolo said the purchase of the property was consummated because of the “collective effort” of Capitol officials and agencies.
Bolo said Garcia, the Cebu Provincial Appraisal Committee (CPAC) and the entire PB, including Vice Gov. Gregorio Sanchez, should also be included for further investigation.
“This is a collective act. Why me all alone? Investigate the body. Collective act sa parties involved. Governor, CPAC, Bolo and PB, which includes the vice governor,” Bolo told reporters.
When sought for comment, Sepulveda said that Bolo has to reserve his answers if there will be a proper investigation.
He also said the fact-finding report does not contain judgment but just stated what happened during the purchase.
He said members of the committee found inappropriate Bolo’s many roles from the negotiation to the consummation of the sale.
“Just to be certain lang the recommendation was that the actions of Bolo be subject of further administrative/criminal investigation. Technically, there was no recommendation of filing criminal administrative charges because we have not identified if naa’y diperensya unsa’y offense ug violations niya. Amoa lang is something is > inappropriate. That’s the report,” Sepulveda said in a separate press conference minutes after Bolo talked to the reporters.
The report stated that “based on the finding of facts, we recommend that the actions of PB member Bolo be the subject of an appropriate criminal and/or administrative investigation.”
Bolo said he “can’t go against the report” of the committee but he said its result indicated it wasn’t over yet.
He said the case is already with the Office of the Ombudsman – Visayas and they may find out that PB, CPAC and Garcia will be included in the investigation.
Bolo said his participation in the deal was spurred by the governor’s order.
He said he wouldn’t have been able to work on the contract without authority from the PB.
Bolo also answered criticisms that he did an executive function by saying that his acts were an extension of the executive department.

“Gisugo man ko. Ang governor gisugo man ko, Wa man ko sugo-a sa Sanggunian. Nagsugo naku pag-negotiate is the office of the governor. Dili on my own. Makapugos kaha ta ug governor ug wa pa ta sugo-a? Mopirma kaha siya sa MOA ug wap-a ta sugoa? Mo-sign kaha siya sa check?” he said.

Bolo also said Sanchez may have a different agenda because he also singled him out and even brought up the idea of suspending him. Sanchez, however, denied this.
Yesterday, Garcia asked the court to order the Balili estate executor to reimburse Capitol P37,810,400 of the P98,926,800 the province paid for the property.
Capitol said the P38 million corresponds to the payment for the submerged and mangrove areas.
Garcia, through Provincial Attorney Marino Martinquilla, filed a civil case before the Regional Trial Court yesterday afternoon.
Martinquilla said lawyer Romeo Balili, executor of the estate of the late engineer Luis Balili, and the latter’s widow, Amparo, offered to sell their property to the Province through Bolo in 2007.
The properties include the two adjoining parcels of lots – Lot 39-C-4-A covered by transfer certificate of title 58357 and another untitled property covered by tax declaration 008592.
After several negotiations by Bolo and with “no adverse claim,” Martinquilla said Garcia executed a memorandum of agreement for the purchase of the properties.
The agreement was approved by the PB last April 21, 2008. The price of the properties at the time they were sold was P400 per square meter.
Martinquilla said Capitol paid Romeo and Amparo a total of P98,926,800 for the properties.
He said that in a relocation survey, Capitol found “that a portion of Lot SP 07-01-000048, consisting of an area of 80,124 square meters, more or less, is submerged and a portion of Lot 2, SP 07-01-000062, consisting an area of 14,402 square meters is a mangrove area.”
He said in the nine-page petition that these facts were not disclosed by Romeo and Amparo. He also said Capitol bought the properties “on the presumption that the same are dry land.”
Martinquilla said that had Capitol been told of the submerged portion and mangrove area, its officials “would have bargained and paid only for the dry land area.”
