    just like jason webb's case, the court does not admit plane tickets, dated pictures or even stamped passports as evidence.Â* for reasons, i don't know.Â* if i am not mistaken, the webb's even had the FBI certify that Jason Webb was in the U.S. at the time of the crime but it was not accepted either.Â* i don't know the legalities to this.
    alibi is such a weak defense of them allÂ* you have toÂ* prove its bodily impossible .....thats why if thats your main defense your in disadvantage position

    that is true but sometimes that is your only defense.Â* that's why there is C.S.I.
    C.S.I not in 25 years if were lucky heheheehe when do you think were gonna have forensic team like that..

    that it true, but if the case was not "orchestrated" the defense cannot also prove beyond reasonable doubt.Â* thus the reason for acquittal under a jury system.

    in a nutshell, that is what makes rape cases unique.Â* sometimes, even just a testimony of the victim corroborated by circumstantial evidences and facts which can be easily staged can already render an accused a guilty verdict especially when highlighted by media only at a single angle. and on the side of the accused his defense of course would only be an alibi.

    but like i said, the turn-out of events had the accused disadvantaged. plus, they had no convincing evidences that could get them out of the hole.

    i guess the late judge OCAMPO favored the testimony of RUSSIA who was the 'material eye witness' of the case instead of the varied documents presented by the defense.

    here's a refresher..

    The reason why Judge Ocampo did not sentence the accuseds to death because he was PERSONALLY torn between his conscience and the weight of the testimonies and evidences presented.Â*WHY?Â* Because in Rusia's testimony he did not see the actual rape and the pushing into the ravine of MariJoy which his very difficult to believe if he was indeed with them.Â* Moreover, he said that during the morning of the rape he was just dropped off if I'm not mistaken, in the vicinity of Ayala or Gorordo which is also quite difficult to believe.

    WHY?Â* Just imagine a bachelor's party and a killing spree.Â* You always do it side by side plus Rusia was even more hardcore than Josman and Paco combined basing on his criminal records.Â* Somebody very influential took very good care of this guy.Â*

    The decision of Ocampo should have been DEATH or ACQUITTAL, nothing in between. If you are going to ask me Judge Ocampo could HAVE NEVER rendered a NOT GUILTY decision during that time AT ALL COST or IT WILL COST HIM HIS LIFE and eventually it STILL did.

    Moreover, a lot of agenices within the authorities, not only the accuseds, WAS NOT SATISFIED in the autopsy and identification of MariJoy.Â* Surambao kaayo!

    ^^but lyt..why did the Supreme Court even nudge the trial courts decision from life to death sentence if indeed there was a lapse of judgment on the part of Ocampo..there must be a considerable cause as to the SC's reaffirmation of the case.

    because that should have been the lower court's decision in the first place or acquittal but with the way it was handled in the lower courts, an acquittal is bleak in the higher courts.
