I am currently in a weird position within the company I work for. I would like to get some ideas on what YOU would do if this happened to you.
I would like readers to note that the thread is simply to make employees aware and vigilant.
Situation:
I was pulled-out from my account by the director of our account to work for a new account. This new account isn't really new since the contract has been signed by the client and company representative almost year ago. It's a flexible account (most work comes in at a certain time of the year and I was pulled-out because it was almost that time of the year) but the company I worked for haven’t started anything yet.
I took the certification process and I passed. So I was tasked by the director to almost establish the account (QA, Training, Equipments needed, etc.). I did, unfortunately the director resigned (reason unknown) while I was in the middle of everything.
The Problem:
While I was working and waiting for an update, a new director was assigned to my account. The problem is, the new director nor the HR didn't know the account existed. They claim to not have seen any contract for this account I was working for. So a HR representative met me and immediately placed me on floating status without pay. I couldn't believe it, so I sent them a copy of the signed contract for the account I was working. Since they couldn't justify my status, they are now claiming that I agreed and signed a document stating that I allow my company to transfer me when an account pulls out (Yes I did but did my account pull-out or even close? I’ve contacted HR before and after my director resigned but never got any answer, not even up to this day).
The Facts:
- The company never terminates employees.
- It's not really just me, there are 5 of us.
- The company has the right to transfer employees to other accounts or tag employees as floating for the following reasons:
- Account Pull-out (no separation pay nor severance pay)
- Poor Performance
- They tried to transfer me to new accounts but I declined because I believe that when they tagged me as floating (same day) without even knowing if my account pulled-out or existed is unlawful.
The Question:
- Do you think it is lawful or unlawful?
- What would you have done?
Let's have a healthy debate guys and gals
