    Now back to the topic .... we'll talk more about the PRESENCE of CAPITOL PEOPLE here in the forums and how would that be an impact in a negative and a positive way , considering na " INFILTRATE " jud nila .

    When you make an allegation it is not libel. Otherwise, it would be impossible to file any cases in court against anybody. For example, if a woman files a case for rape against somebody, of course that is likely to destroy the accused rapists' reputation. But it is not libel because neither truth nor malice can be proven nor disproven at the time of filing the case.

    Same with public officials. If someone alleges that Capitol is corrupt, that should not be the basis for an action for libel. In the United States, it isn't, and I have reason to believe it should not be so here either. The media in the U.S. is far more vocal, especially talk radio, against government officials. They even accused Obama of being a communist or being corrupt, etc but never do you hear of a libel case filed against these people. Because an allegation in itself is not a statement of fact, but a statement of suspicion regarding further investigation. If one cannot allege someone is corrupt, then how can anyone file a case for corruption against a government official? That would defeat the purpose of anti-corruption laws which are intended to defend the public against wasteful spending by corrupt officials.

    That is why if a forumer says they believe Garcia is corrupt, that cannot be considered libel. It is merely an expression of belief and an allegation. So I think forumers should go on as they are and not fear these politicians otherwise we are letting these evil tyrants destroy our democracy and freedoms.

    Who knows what could be the reason why people call her a bitch. Words can have so many meanings, sometimes it is not the dictionary meaning of the word that attaches and that the word is only used as a placeholder for the emotions of the person writing it.

    For example, the word bitch.. that could mean literally, like a whore who has rampant *** with men of questionable character, it could mean "maltida nga wa sa lugar", it could mean kurakot, it could mean hambugera, it could mean narcissistic as in obsessed sa iyahang nawong, it could mean name-dropper, it could mean influence peddler, it could mean bogo og incompetent. It could also mean all of the above, who knows.

    And so it's impossible to glean what a person could possibly mean by saying Gwen is a bitch, they could have many reasons for doing so and the best option is simply to ask them what they really meant instead of jumping to the conclusion that they are already committing libel. After all, how oftentimes do we here about so and so person being a bitch, but do we automatically believe that literally means she sleeps around? Of course not, it could mean anything.. it needs clarification.

    The reason why it's not libel is because under applicable laws, anything filed with the court is "privileged", as long as it is relevant to the issue of the case. So if someone is charged with rape, that's not libel. If it turns out that the guy is innocent, then perhaps he can counter-sue for perjury (for false statements in the complaint) or malicious prosecution.

    Another instance of "privileged communication" are the "privileged speeches" of senators and congressman. It's because of this that Jinggoy is challenging Ping to repeat his statements outside of the senate, to that he could be sued for libel.

    Generally speaking, there is a "presumption of malice" by the mere fact of the publication (in writing or spoken), even if the malicious statement is true. This means that the person charged has the burden to prove that he made the statement for good motives, etc. So if your neighbor calls you a rapist, then the law presumes that the purpose of doing that was to destroy your reputation, etc., and he has to prove otherwise.

    However, when it comes to public officials or "public figures" (politicians, showbiz people, etc.), there is no presumption of malice, and the public official has to prove that there was actual malice by the accused when he made the libelous statement. According to the Supreme Court, the reason is that public officials should not be onion-skinned and take offense at any criticism, no matter in what form or manner it may be made.

    can you file a libel case to a person who filed libel case against you? Charging him/her of libe because of insinuating the you are libelous?
