    Default question: regular employee benefits


    hi guys, just want to ask.. is there any law/policy here in the phils na dapat ihatag ang regular employee benefits sa mga bago na regularized sa amo company?

    here's the thing.... kami ang pioneering batch we were given a raise sa amo night differential (from 10% to 20%) and attendance bonus (from P500 to P1000) upon regularization. so the next batch was up for regularization (i think last week ba to or 2 weeks ago), but ang amo director gi ingnan sila same ra ila madawat like unsa ila nadawat kato probees pa sila (so meaning wala sila hatagi sa benefits na gihatag sa amoa)... pwede ba ni? or is there a law/policy against this?

    need ur help guys, para protection pud ni sa ako workmates in the future.... thanks

    tan.awa daw ang copy sa contract bai.... ask them to compare it with their proby contract. Its gonna be a regular employment contract so any additional benefits, if any, should be indicated in the terms. Non-government mandated benefits (fringe benefits) can be stopped or suspended by the employer, pero do ko sure if ang increase during regularization is required based on our labor code. From what I read, it wasnt stated there. Based on my experience, everytime mo sign kog regular employment contract, naa man jud increase. You can consult NLRC also, it's free anyway. Or if kinsa tong mga members nga lawyer or nay background sa law diri, hopefully mka help....

    mao na problema, even tho regular na ko and some of my workmates, wala mi hatagi ug new contract with the new benefits ... the only contract I signed was last year kato probee pa ko. they told us na dili daw need ang new contract, just a note na regularized na mi ... ambot wala jud kler noh?

    no need na gyd na ang new contract ky same company lng bya na ghapon imo g workan. bsta mo lapas kag 5 mnths regualr nka. ad2 sa inyo hr ask unsa inyo benefits

    naa mn gyd nang 13th mnth bai bsan sa contractual. naa na sa labor code 143

    inato nga explanation ha para masabtan....example... na hire ka August 1, 2009 sugod naka work, ang status nimo ani kay PROBATIONARY, mag ihap ka ug 6 months gkan sa august 1, 2009, so February 1, 2010 mao na last day sa imong pagka-probationary. Inig ka February 2, 2009, the next day...you are already a regular employee..no need na ang new contract...understood nana nga kay wala man ka pahawa-a pagka Feb. 1, 2009 for regular naka.

    Ang probationary limited ra ang benefits ana...ang madawat ana nila kay SSS, HDMF, PHIC, 13th month pay pero pro-rate, mao jud na ang kasagaran nga practice

    Inig ka regular na nimo...apil na diha ang vacation/sick leave, other bonuses nga ihatag sa company.

    About sa increase sa sweldo or sa allowance, depende na sa company kung kaya nilang mag increase...dili na compulsory nga ang company mohatag ug increase sa sweldo not unless naay across the board wage increase.

    Usually ang style sa company kung mag increase sila sa imong sweldo inig ka regular nimo kay mag conduct na sila ug performance evaluation, dha sila mo base kung pila ang increase ilang ihatag.

    normally, the company lets you sign a new contract as a regular employee. This is practiced by universities and most of the establishments here. Though 1 day after the last day of your probationary period, you're already considered regular if you're still working in that company. To emphasize the security of tenure, a new contract is issued. Usually, to stress out the additional benefits that an employee is supposed to receive. The best that you can do is consult NLRC.

    6 months bai.... though pwede sad ka e regularize prior to to the end of you probationary period like 5months or less..
